Swiss police's office abuse Fair Trials in Zurich Courts needed– Exposing Judicial Bias!

Over the past few years, without any media exposure or updates on social media in Switzerland, particularly in the canton of Zurich, I have observed several cases of corruption and abuse of office within government offices, including police departments. Whenever someone is mistreated by the Swiss police, in most cases the courts dismiss the case, and the accused police officers are not even investigated. In the cantons of Vaud and elsewhere in Switzerland, innocent people have been killed by police, yet no officers have been held accountable.


Recently, a similar situation occurred in the United States, where an immigration agent fatally shot a woman. Even after that incident, the government seemed unwilling to acknowledge its mistakes. A similar lack of accountability appears to be happening in Switzerland from several years. Because of Data Privacy law and well organised Swiss media accused police and govt officials are not exposed for years.


Therefore, I have decided to bring these matters to social media so that Swiss citizens can become aware of how police are being given an extra layer of protection, even after misusing their power.

Recent cases handled by the III Criminal Chamber of the Zurich High Court were dismissed despite the presence of video recordings and other substantial evidence implicating police officers in alleged abuse of authority. In one case, the Swiss Federal Supreme Court returned the matter to the lower court for re-examination, raising serious concerns about how these cases were initially handled.

These decisions create the impression that public officials receive special protection within the justice system. Legal delays and a lack of transparency leave victims and their families without justice and undermine public trust in the rule of law. In Switzerland, no one should be above the law accountability must apply equally to all, including those entrusted with enforcing it. 

Journalist Kamath points to Article 110(3) of the Swiss Criminal Code (StGB) as a major weakness that effectively shields public officials from swift criminal prosecution. In his assessment, this loophole leads to delays that deny justice to victims:

“The legal framework is structured in such a way that prosecutors cannot act quickly when the accused is a government official. During these prolonged delays, victims often lose hope or come under pressure, and countless cases end up buried in the files.”

In Switzerland, all citizens including police officers must be held accountable for their actions. When courts issue decisions that give the impression of bias, this undermines trust in the justice system.

 

 

 

 

 

 

In recent years, not only foreigners or undocumented migrants, but also Swiss citizens have been killed by Swiss police officers, even though the individuals concerned were innocent. In many cases, the officers were acquitted by the courts, often on the grounds of insufficient evidence, leaving the victims’ families without justice.

The cases we have highlighted point to possible failures in dealing with abuse of office and human rights violations. If these incidents are not investigated transparently, victims are left without justice and the rule of law is endangered.

Under Swiss law, Article 312 of the Swiss Criminal Code (StGB) – Abuse of Official Authority, provides for up to five years’ imprisonment for public officials who abuse their power to cause harm to someone or to obtain an unlawful advantage.

Request for Independent Review and Transparency in Zurich Courts

To the Government Council of the Canton of Zurich and the Judicial Oversight Authority of the Canton of Zurich

Dear Sir or Madam,
We, the undersigned, are concerned about recent cases handled by the III Criminal Chamber of the Zurich High Court, including cases TB250057-O/U and TB240090-O/U/HEI>MUL, in which substantial evidence against police officers was presented in two separate incidents. Nevertheless, these cases were dismissed by the Zurich High Court.
In case TB240090-O/U/HEI>MUL, following an appeal to the Swiss Federal Supreme Court, the case was referred back to the lower court so that the accused police officer who is seen committing abuse of authority in a video could be re-examined. Click here to read court order 1C_246/2025.

This court order clearly shows how court to covering up the action of police officer. 

 We therefore respectfully request that you:

  • Initiate an independent review of these decisions to determine whether judicial bias influenced the outcomes.
  • Ensure greater transparency in the handling of cases involving public officials.
  • Implement measures that guarantee fair and impartial proceedings for all citizens in Zurich courts.

We believe these steps are essential to maintaining public confidence in the justice system and upholding the principles of the rule of law in Switzerland.

It must be clear that Swiss police officers must also be held accountable for their actions in cases of human rights violations and abuse of authority committed on Swiss soil.
