Commission employees REFUSED to calculate Dustin's loss of earnings as a result of changes to his earning capacity via restrictions put in place by his GP on Sept 27, 2022!

Section 74: The commission may reopen, rehear, redetermine, review or readjust a claim, decision or adjustment, where

(a) an injury has proven more serious

or less serious than it was considered to be;

(b) new evidence relating to the claim, decision or adjustment has been presented to it;

He was told that UNLESS he signed a form 6 NOTHING would CHANGE! ILLEGAL!

Application at time of ORIGINAL INJURY ONLY!

Section 64(1)(a)

They said it was used for a "recurrence"!

You do NOT report a "recurrence"! You present medical evidence AND the employees determine IF the symptoms REPORTED by your MEDICAL PROFESSIONALS MATCH YOUR ORIGINAL INJURY!

Dustin DID NOT GIVE THE COMMISSION A LIST OF SYMPTOMS FROM HIS GP!

Injured workers REPORT NEW INFORMATION in the form of MEDICAL PROOF ONLY!  

A loss of earnings NOT in the form of medical proof would arise IF the employer was no longer able to accommodate the injured worker!  In the case of your injury employer, THEY should be the ones reporting that loss of earnings NOT the injured worker!

If it was NOT the injury employer, the injured worker SHOULD request the new employer to report the loss of earnings and explain HOW it is a result of the injury!

The injured worker would report unfair results to the commission IF the decision of the commission caused those results!

We have reported UNFAIR results since Aug 5, 2019 recurrence and the commission DID NOTHING to IMMEDIATELY STOP THOSE UNFAIR RESULTS!  

Again, the commission broke Section 20(4) WHSC Act, 2022 and Policy EL-01 Exceptional Circumstances since Aug 5, 2019 recurrence and continues to AVOID the facts that they did break their own laws!

 

Sonya Stanford HAS TO ADDRESS THIS IMMEDIATELY!  This is a staffing issue where the staff needs to be held LEGALLY ACCOUNTABLE!  It is NOT A CASE FOR INTERNAL REVIEW!
