New York State Emergency Medical Services Fitness Act
SECTION 1. TITLE
This Act may be cited as the "Emergency Medical Services Fitness Act of 2025."
SECTION 2. FINDINGS AND PURPOSE
(a) The Legislature finds that:
The physical demands on Emergency Medical Services (EMS) personnel, including both paid and volunteer members, necessitate a high level of physical fitness to perform tasks efficiently and safely.
Strength, cardiovascular, and endurance capacities are critical to the effective performance of EMS duties.
A comprehensive fitness assessment can help ensure that all EMS personnel are capable of meeting the physical demands of their roles, thereby enhancing the safety and well-being of both EMS personnel and those they serve.
(b) The purpose of this Act is to require all EMS agencies within the State of New York, regardless of their personnel's employment status, to incorporate strength testing, and cardiovascular and endurance evaluations into the annual physical health examination for their personnel.
SECTION 3. HEALTH EXAMINATION REQUIREMENTS FOR EMS PERSONNEL
(a) General Requirements:
All EMS agencies operating within the State of New York are required to ensure that their personnel undergo an annual physical health examination. This examination is crucial for assessing the physical and medical fitness of EMS personnel to perform their duties effectively and safely.
(b) Examination Components:
The annual physical health examination must be comprehensive, covering various aspects to ensure a thorough assessment of each member's health and fitness. The examination must include:
Vision and Hearing Tests: To ensure the member has the necessary visual and auditory capabilities for emergency response operations.
General Physical Examination: A broad assessment covering essential health markers and physical condition, conducted by a licensed healthcare provider.
Laboratory Work: As deemed necessary by the healthcare provider, to identify any underlying health issues that could impair the member's ability to perform their duties.
Physical Evaluation to Assess the Ability to Lift a Minimum of 50 Pounds: A crucial test to determine the member's capability to handle the physical demands of EMS work, including lifting and moving patients and equipment.
Cardiovascular Fitness Test: An evaluation of the member's heart health and endurance, confirming their ability to undertake high-intensity tasks over prolonged periods.
Endurance Assessment: To measure the member's stamina, emphasizing their ability to maintain physical activity and alertness throughout extended emergency response operations.
(c) Administration and Design of Tests:
These tests must be designed and administered by qualified health professionals, following guidelines developed in consultation with experts in occupational health and fitness. This ensures that the evaluations are not only consistent and standardized but also tailored to reflect the unique physical demands placed on EMS personnel.
(d) Documentation and Compliance:
EMS agencies are required to maintain up-to-date records of all health examinations, demonstrating compliance with this section. These records must be made available for review by the relevant State health and EMS authorities upon request.
SECTION 4. IMPLEMENTATION AND COMPLIANCE
(a) The New York Bureau of Emergency Medical Services and Trauma Systems shall develop and publish guidelines for the administration of the strength, cardiovascular, and endurance testing components of the physical health examination.
(b) EMS agencies shall report compliance with the fitness examination requirements to the New York Bureau of Emergency Medical Services and Trauma Systems on an annual basis.
SECTION 5. FUNDING AND RESOURCES
(a) The State shall provide resources and support to all EMS agencies to assist with the implementation of the enhanced physical health examination requirements.
(b) The New York Bureau of Emergency Medical Services and Trauma Systems and EMS agencies may seek grants and other funding opportunities to offset the costs associated with the fitness examinations.
SECTION 6. EFFECTIVE DATE
This Act shall take effect on January 1, 2025, providing EMS agencies adequate time to comply with the new requirements.
SECTION 7. SEVERABILITY
If any provision of this Act, or its application to any person or circumstance, is held invalid, the remainder of the Act, or the application of such provision to other persons or circumstances, shall not be affected thereby.
