Under the current version of the Online Safety Act 2021, not all images posted by former partners/spouses fall under the definition of 'intimate image', making it impossible to have images removed.

Strengthening the Online Safety Act 2021 is critical, to allow victims of domestic or family violence and abuse an easier way to have removed, images of them posted or shared online without consent, by a former partner, spouse or associate.

The Act also needs to restrict former partners/spouses from following victims on social media and other online platforms.

Social media and others platforms will have compliance obligations under the Act.

The definitions in the Act need to be expanded, so that any image of the victim posted without consent can be removed if requested.

Even if there is no nudity or intimate act in the image, the image may have been captured without consent or by posting the image, the former partner/spouse continues to exert coercive control and psychological trauma, even if an AVO is in force.

Even if a victim blocks a former partner/spouse on social media, the perpetrator can still find ways to cyberstalk the victim and all loopholes need to be closed.
