Strengthen Business Protection in Consumer Credit Card Disputes and Business-to-Business Contracts
The Issue
My personal experience as a business owner has recently compelled me to seek change in our system. A client who failed to heed our cancellation policy disputed a charge on their credit card. They misrepresented the situation to their bank and were instantly refunded. This happened without any consideration or investigation into whether they had a legal right to do so. The result? My business suffered a loss because the bank protected the consumer before seeking any form of clarity.
This incident highlighted two crucial issues that we need to address. Firstly, in disputes involving clients who make a claim on a credit card, businesses are instantly at a loss. In these instances, consumers receive an instant refund pending an investigation, regardless of whether they have a legitimate claim. Secondly, there are no legal rights for business-to-business consumers to cancel a contract after signing, limiting their flexibility and potentially trapping them in unfavourable conditions.
However, it is important to note that there is a need for balance. The Fair Credit Billing Act, enacted for the protection of consumers, is vital in many cases. But, businesses also need to be taken into consideration. It is reported that UK business lost 2.6 billion due to abuse.
We propose a revision and modernisation of these rules where the rights of both parties involved in transactions - particularly small businesses often hit the hardest - are considered fairly. This could include a more extensive investigative process, to prevent instances where one party takes advantage of the system at the expense of the other.
Let's request a legal re-evaluation that aims to protect business rights without minimizing consumer protections. Please join my call to promote balance, justice, and fairness in business transactions. Sign the petition today.
