Stop USPS proposal to allow handguns to be sent through the mail
The Issue
For nearly 100 years, it has been illegal to mail a concealable firearm — a pistol or revolver — through the U.S. Postal Service. Congress passed that law in 1927 specifically to curb crime. The Trump administration now wants to undo it.
Last month, the U.S. Postal Service proposed a new rule that would allow anyone — not just licensed dealers — to mail handguns through the mail. The proposal follows a January opinion from the Department of Justice calling the 1927 law unconstitutional, arguing it violates the Second Amendment.
Attorneys general in nearly two dozen states have already pushed back, sending a letter to USPS urging it to withdraw the rule. They warn it will create a mechanism for people who cannot legally own guns — including those convicted of felonies or domestic violence — to obtain them while bypassing the background checks, firearms safety courses, and mental health history checks that states have put in place. Private carriers like UPS and FedEx already restrict gun shipments to federally licensed dealers. The postal service would have no equivalent safeguard.
John Feinblatt, president of Everytown for Gun Safety, said the rule change will turn USPS into a "gun trafficking pipeline" for illegal weapons "while stripping law enforcement of the tools they need to prevent and investigate gun crime."
The executive branch does not have the authority to unilaterally ignore a law passed by Congress. This rule must be stopped.
