Stop Unlawful Police Force In California

The Issue

In recent years, California, especially cities like Sacramento, has seen a troubling rise in incidents involving unlawful police force. These events have raised serious concerns about the integrity, effectiveness, and accountability of law enforcement agencies. 

One of the most notorious cases was the tragic death of Stephon Clark in 2018, an innocent African-American man who was shot in his grandmother's backyard. This incident highlighted the urgent need for reform and accountability. Last year, the California Department of Justice reported that fatal police shootings increased by over 5%, a statistic that should alarm us all. 

The use of excessive force is not only morally wrong but also damages community trust. It disproportionately impacts marginalized communities, eroding the public's confidence in those sworn to protect and serve. According to a recent study by the Center for Policing Equity, African Americans are over three times more likely to be subjected to force than their white counterparts. 

We call on the California State Legislature and the Governor to conduct a comprehensive, transparent investigation into these cases of police misconduct. This effort should focus on systemic reform. We urge the California State Legislature to enact laws requiring comprehensive training programs for all officers and the implementation of body-worn cameras to ensure transparency and accountability.

  • Implement mandatory de-escalation training. 
  • Ensure the utilization of body-worn cameras across all law enforcement agencies. 

To truly address police accountability, we must also consider related reforms that contribute to community safety and trust:

  1. Advocate for integrating mental health professionals with law enforcement so that individuals in crisis receive appropriate care rather than punitive action. 
  2. The creation of independent oversight boards to investigate police misconduct, ensuring accountability and transparency. 
  3. Mandate ongoing training not just in de-escalation, but also in areas like cultural competency, bias recognition, and mental health awareness. This prepares officers to handle a variety of situations more effectively and sensitively. 

The long-term goal is to ensure equity in law enforcement. This includes addressing systemic racism and inequities within the justice system as a whole, not just focusing on police practices. 

Some policy ideas to address this issue are:

  • Mandatory training, including training on implicit bias, anti racism, mental illness, and age-appropriate responses to reduce discriminatory practices. 
  • Facilitate community forums to allow residents to express concerns and suggestions regarding local policing practices.
  • Enhance polices and accountability by;
    • banning chokeholds and strangleholds
    • Mandating the police department to settle misconduct lawsuits with their own budgets to create financial accountability for misconduct. 
    • suspending the use of paid administrative leave for officers under investigation for incidents of police brutality to ensure a more rigorous investigation process. 
  • Hold police departments financially responsible for negligence rather than relying on public funds to settle misconduct lawsuits.
