The Issue
STAND UP for justice! Make it clear that NO ONE is above the law! STOP the four times criminally indicted, twice impeached, disgraced former president, Donald J Trump from ever becoming president again.
According to Section 3 of the 14th Amendment of the Constitution of the United States, the former president, Trump, is NOT eligible to hold elected public office. Please join us in petitioning our Michigan Secretary of State, Jocelyn Benson to make sure that Donald J Trump (if the Republican presidential nominee) be removed and barred from appearing as a candidate on Michigan's 2024 ballots.
This is indeed unprecedented in our American Democracy's history, but the former president's illicit, seditious, and allegedly criminal actions in order to illegally remain in power, trying to create a dictatorship, are unprecedented and should never be allowed to be repeated.
According to a Federalist Society paper, authored by University of Chicago professor William Baude and University of St. Thomas professor Michael Stokes Paulsen, that will be published in the University of Pennsylvania Law Review next year, they argue that Trump’s behavior between November 2020 and January 2021 clearly excludes him from running for or holding office.
- “The most politically explosive application of Section 3 (of the 14th Amendment) to the events of January 6, is at the same time the most straightforward,” Baude and Paulsen write. Section 3 of the 14th Amendment — a provision that limits people from returning to public office if they have since “engaged in insurrection or rebellion” or “given aid or comfort” to those who have.
- “Former President Donald J. Trump is constitutionally disqualified from again being President (or holding any other covered office) because of his role in the attempted overthrow of the 2020 election and the events leading to the January 6 attack,” Baude and Paulsen explain.
- Endorsing the view advanced by Baude and Paulsen, Laurence Tribe, a liberal law professor, and J. Michael Luttig, a conservative former judge for the U.S. Appeals Court, wrote an article for The Atlantic, “The former president’s efforts to overturn the 2020 presidential election, and the resulting attack on the U.S. Capitol, place him squarely within the ambit of the disqualification clause, and he is therefore ineligible to serve as president ever again.”
Governor Gavin Newsom, CA, is proactively asking for state legislation to keep DJT from being on CA state ballots, however, legislation is NOT necessary. For each state in America, it is The Secretary of State that makes the decision to remove or bar candidates from the ballot.
