Stop The Silence Stand for Injured Workers

The Issue

My journey through the workers’ compensation system has been defined by obstruction, silence, and a lack of transparency. As a self-represented injured worker, I watched how decisions being made about my case without my knowledge or consent. Records were withheld, requests were ignored, I was shut out of my own case.

 

Even after dismissing my attorney to protect my rights, I faced more resistance instead of neutrality. This is not due process this is systemic failure.

 

I have been without workers’ compensation benefits for four years, not because my claims lacked merit, but because the system failed to provide transparency and accountability. During this time my health has deteriorated, I face the risk paralysis, and I’ve lost my home, my family, and stability, the support workers’ compensation is meant to provide.

 

This is not just my story, countless injured workers are trapped in a system were,

•  Access to their own medical and claims records is limited, creating obstacles to fair treatment and timely resolution.

•  Benefits are delayed, wages are miscalculated. or disability levels are misclassified.

•  Administrative errors and altered filings go unchallenged.

•  Self-represented applicants are treated as invisible.

When workers are denied basic access and resources, their health, income, and future suffer. A system meant to protect injured worker's instead causes harm.

 

 

We are calling for immediate reform,

•  Direct, timely access to all workers’ compensation records, filings, and correspondence, included promptly digital copies upon request.

•  An independent audit and enforcement mechanism to investigate and sanction violations with claims administration handle by an independent entity that provides real oversight and review of due process violations.

Timely issuance of worker's compensation benefits, including temporary and permanent disability payments, with penalties for unjustified delays, underpayments, or improper denials.

We have also included the California Department of Insurance (CDI) to ensure that insurance carriers and claim administrators are properly handling claims and following regulations. While the CDI does not directly manage workers’ compensation cases, it monitors insurance practices and systemic compliance, making it a crucial oversight body for protecting injured workers.

 

The Workers’ Compensation Appeals Board (WCAB) and all oversight authority must act now.

 

Please sign this petition to demand transparency, accountability, and fairness. Injured workers deserve access to their cases, meaningful due process, and a system that truly protects them, now and in the future.
