Stop the Misuse of the RICO Statute

The Issue

We must put a stop to the misuse and overuse of the RICO statute here in the United States of America.

Who is Impacted?
The Racketeering Influenced and Corrupt Organizations (RICO) Act, originally enacted in 1970, was designed to eradicate the infiltration of legitimate businesses and organizations by those involved in organized crime. During this time period, this was a major issue arising in our country. RICO allows investigators to not only bring charges against the foot soldiers that committed the crimes and provided legal isolation for their bosses, but also charged those bosses who sent down the orders and never got their hands dirty. 

Over the years; however, the application of RICO has morphed far beyond its original purpose, impacting a wide range of people and organizations. Some of these include, protesters, political groups, young men from impoverished neighborhoods, musicians, entertainment moguls such as P. Diddy, parents in alleged college cheating/bribery scandals, and even our President elect Donald Trump.

What is at Stake?
This expansion and overuse of RICO poses series concerns about the implications for civil liberties and due process. The language of the statute was initially drafted with vagueness and ambiguity. This was due to congress rushing through RICO's enactment to address the issues with organized crime. This vagueness created misinterpretations, arbitrary enforcement, and most importantly, series questions about the overall constitutionality of the statute from the very start.

Why is Now the Time?
Now is the time to stop the overuse and abuse of RICO because the longer we wait, the more flexible and pervasive it will become. This procrastination will continue to impact so many individuals and contaminate every aspect of our nation.

As we can see, our current president elect was not immune from its reach and neither was Rudy Giuliani, who was a former prosecutor that made history by using RICO to prosecute "mob" bosses back in the 1980's.

We, the undersigned, are calling for a critical examination and reform of the Racketeering Influenced and Corrupt Organization (RICO) Act, and similar conspiracy based statutes.


*Reasons for Reform*

1. Unconstitutionally Vague: The breadth of the RICO statute leads to ambiguity in its application, making it difficult to understand what constitutes a violation, thereby infringing upon our rights. Additionally, it allows a wider range of testimonial evidence to be admissible, which leaves many defendants with no choice but to plead guilty in order to avoid harsh punishments.

2. Overreach and Abuse: The potential for abuse by authorities and prosecutors can lead to harsh penalties and consequences for individuals who may not be involved in criminal enterprises at all.

3. Eroding Public Trust: Misuse of the RICO statute contribute to a broader perception of injustice in our legal system, undermining trust in law enforcement and the judiciary.


*We Demand...*

* A comprehensive and up to date review of the RICO statute and landmark cases that challenged RICO as being unconstitutionally vague.

* If a current unconstitutional challenge of the statute is survived, we demand Legislative action to amend the statute to eliminate any vagueness or ambiguity; therefore, it protects the citizens of our country from unjust prosecution. This includes more efforts from the government to educate our society, most importantly our youth, about such complex laws. 

* Less power and discretion in the hands of U.S attorneys and federal law enforcement officers in which give them the ability to utilize RICO more aggressively on certain citizens. This includes additional training overall for lawyers handling RICO cases.

* A complete reform of the conspiracy aspect of these types of statues. 

 

Join us in standing up for justice and the protection of our rights as American citizens. We understand that crime is an important issue in our country. RICO may seem like the proper solutions; however, that is mainly due to the lack of understanding that  our society has of its purpose. Please do not misconstrue this petition as an attempt to help criminals get away with committing crimes. Every act that is said to be done in furtherance of an alleged RICO enterprise could still be properly prosecuted absent of the RICO statute.
