STOP THE KINGSTON MUSLIM ASSOCIATION (KMA) MOSQUE FROM BEING CONVERTED INTO A CIO.

STOP THE KINGSTON MUSLIM ASSOCIATION (KMA) MOSQUE FROM BEING CONVERTED INTO A CIO.
The Issue
Asalamu Alaykum Warahmatullahi Wabarakatuhu
Dear Brothers and Sisters,
As you are undoubtedly aware, several mosques throughout the United Kingdom are experiencing similar issues of forceful CIO (a charitable incorporated organisation) conversions from an unincorporated legal status or other statuses by trustees who are only interested in obtaining the assets for personal control and then selling the assets.
A brief description of the Charitable Incorporated Organisation (CIO) which is a form of a legal entity suitable to certain organisations who may handle large amounts of money and want to protect their trustees and management against liability. However, this is not suitable for our own charity or our needs. This new form of legal structure brings with it a whole host of risks that the community cannot afford to take for the sake of protecting the trustees alone. The interest of the Mosque and the Community is far greater than that of any trustees.
The current unincorporated charity, The Kingston Muslim Association (KMA), has served us well and has been befitting and accommodating our local community for over 20 years. This is where our Mosque, The Kingston Muslim Association (KMA), is experiencing difficulties with the current operational management and its Board of Trustees. The public opposes this conversion and wants the assets to be protected by its original trustees. The current trustees were entrusted by the community of Kingston to manage the affairs of the Mosque and safeguard its interests.
The trustees/management team (they are one and the same) who were entrusted with running the affairs of the mosque on behalf of the Kingston community. They have been conspiring and colluding behind closed doors and conducting their illegal affairs in secret against the wishes of the community, whereas some supporters of the current trustees are being naively manipulated including the local community.
Unfortunately, we have reached a stage where we have to raise our voices against this corruption within our communities and mosques. As Muslims, it is our responsibility to protect our culture, mosques and our heritage from the pollution of corruption, illicit activities and avarice which is currently ongoing at the KMA mosque and plaguing our society.
Those who oppose the current trustees and the management team are being incarcerated or maligned and silenced by the current trustees of the KMA whose financial capacity is greater, to appoint agents or agencies only to benefit them.
We would like the original trustees of the KMA to be elected and retain control of the mosque, and a new committee established. Wherein the local community and its adjacent areas would benefit, especially the devout users and worshippers of the mosque to have an open and vocal hearing publicly addressing how the mosque is being managed.
Now, the majority of the community has steadily awakened to the fact that there are internal problems within the KMA and would like answers and actions taken, to:
To end with the dissolution of the CIO conversion of the KMA.
Stop using the mosque as collateral for business activities or illegal activities.
Prevent the select few “current” trustees from having Absolute power over an Asset or Assets that belong to a Trust.
1. Why are you forcibly trying to convert the KMA mosque's legal status to a CIO?
2. Why are the current trustees and the management team not listening to the wishes of the local community who helped donate to build the KMA?
3. Is the appointment of the current trustees legitimate?
4. How were the current trustees appointed?
5. Why are the clerics being demonised and undermined by them?
6. We would like transparency and accountability in the KMA financial affairs?
7. We would like the charity's commission to conduct a thorough investigation into the charity to ensure that no other malpractice, mismanagement or misconduct has taken place.
8. Eject and disqualify all current trustees and the management team who have betrayed the trust instilled in them and who initiated this unjust action on the charity and its community.
9. Ensure that the affairs of the charity is brought back to the community to choose more worthy trustees and a management committee who are open, transparent and accountable to them.
We trust the Muslim ummah to understand and comprehend that this is a difficult and apparent problem faced by all the Muslim communities nationally, especially in the community of Kingston. With some people’s hostile intentions and attempts to steal the Mosque from the community by the very people whom the community had trusted to manage and safeguard the Mosque.
Why do we need your signature?
· To stop the transfer of the Assets of The Kingston Muslim Association (including the buildings and land).
· To stop the conversion to CIO of the KMA and all mosques who have currently been subjected to akin difficulties throughout the United Kingdom.
· To prove to the charity’s commission that the entire community of Kingston is against the actions of the current trustees and the operational management and we will not be bullied into submission by the actions of a few.
· We call upon all the mosques and the community members in their respective locales and the ummah to unite with us and stand together as a coalition against this malfeasance!
