STOP THE HUM - Enforce Buffalo’s Noise Ordinance

The Issue

To:
Buffalo City Council, Office of the Mayor, Buffalo Police Department (BPD), and Department of Permit and Inspection Services (DPIS), Citizen Services Division, Buffalo Common Council, Councilman Joseph Golombek, Councilman Joel Feroleto

Introduction:
Far reaching, droning humming noises coming from areas at or near facilities such as Wieland (70 Sayre Street) and Materion (2978 Main Street) have long disturbed our neighborhoods, reaching over 2 miles away from their sources. Go to StopTheHum.org to listen to the noises and look at measurements.  These persistent low-frequency noises have disrupted the daily lives of residents across Buffalo, depriving them of sleep, increasing stress levels, and posing long-term health risks.

The Problem:
Residents across Buffalo suffer increased stress, interrupted sleep, and reduced productivity due to these noises. Buffalo Code §§293-5 (Five Decibel Limit) and 293-6 (Methods of Measurement) clearly define acceptable noise levels. Despite numerous 311 calls and direct complaints, city agencies have acknowledged challenges in enforcement due to absolute lack in equipment, training, and mandate. This gap leaves industrial violators unchecked and the community unprotected.

Our Demands:

  • Immediate Independent Investigation:
  • Contract certified, third-party sound experts to conduct comprehensive noise surveys at the affected industrial areas.
  • Establish dedicated and easily accessible reporting lines for residents to submit noise complaints.
  • Equip and Train Enforcement Agencies:
  • Provide BPD, DPIS, and other relevant agencies with certified noise measurement tools (e.g., octave band analyzers).
  • Implement specialized training for personnel on measuring and enforcing noise regulations effectively.
  • Assign Clear Responsibility and Accountability:
  • Formally designate a specific city agency to lead industrial noise enforcement, with clear authority to issue violations and fines.
  • Create a transparent, publicly accessible record of noise complaints and enforcement actions.
  • Hold Industrial Violators Accountable:
  • Require companies such as Wieland and Materion to implement effective noise mitigation measures.
  • Ensure that the designated enforcement agency applies penalties in a timely and consistent manner when industrial noise exceeds legal limits.
