Subject: A Call for Balance — Holding CPS and Our Courts Accountable to All Victims

 

We, the undersigned, petition for urgent reform in the handling of child abuse allegations within the Child Protective Services (CPS) system and family courts. While we support the mission to protect children, we are alarmed by the growing misuse of these institutions through false and weaponized allegations during custody and divorce proceedings.

 

Why This Matters

CPS and the courts are vital to child safety — but when they act on unverified claims without investigation, or impose punitive measures without requiring sufficient evidence, they become instruments of harm rather than protection.

 

False accusations do irreparable damage:

 

Children are wrongfully separated from loving, stable parents and relatives.

 

Innocent individuals suffer public shame, emotional trauma, financial ruin, and professional loss.

 

Families are torn apart by conflict they did not create.

 

The accuser often faces no consequence for filing knowingly false reports.

 

This represents a serious failure of justice and a betrayal of public trust.

 

We Demand the Following Reforms

Due Process and Impartial Investigation

CPS and family courts must conduct thorough, unbiased reviews of all allegations and refrain from taking action based solely on unsupported claims.

 

Legal Consequences for Proven False Allegations

Individuals who knowingly make false accusations must face appropriate legal penalties, including fines, perjury charges, restitution, and potential loss of custody or visitation rights.

 

False Allegation Offender Registry

A confidential registry should be maintained for individuals found guilty through due process of filing false abuse claims, accessible to courts and CPS to prevent repeat offenses.

 

Cross-Training for CPS and Family Court Personnel

Judges, attorneys, caseworkers, and law enforcement should be trained to identify manipulation tactics, particularly in high-conflict custody cases.

 

Support for the Wrongfully Accused and Their Families

Those harmed by false reports should have access to legal aid, trauma recovery services, and financial assistance to rebuild their lives and reputations.

 

Oversight and Right to Appeal

An independent review board must be established to examine contested CPS decisions and questionable court actions. Affected families must be given the right to appeal.
