Justice Must Never Be Political. Due Process Must Come Before Extradition.

Andrew and Tristan Tate are American citizens currently being held in federal custody in the United States while the United Kingdom seeks their extradition.

This petition is not about asking anyone to decide guilt or innocence.

It is about protecting the constitutional rights of American citizens, preserving due process, ensuring that international legal agreements are respected, and demanding that extradition decisions be based on law and evidence—not politics, public pressure, or media narratives.

Every American should care about this case because if due process can be compromised for controversial individuals today, those same principles can be weakened for anyone tomorrow.

 
Why This Matters
For nearly four years, Andrew and Tristan Tate have been involved in extensive legal proceedings in Romania.

Throughout those proceedings, they have consistently denied all criminal allegations.

In March 2024, a Romanian court approved the United Kingdom's extradition request in principle but ordered that any surrender to the UK be deferred until the Romanian criminal proceedings had concluded.

Supporters of the Tate brothers argue that the current effort to extradite them from the United States while Romanian proceedings remain unresolved raises serious questions about whether that Romanian court decision is being respected. UK authorities continue to pursue extradition through U.S. legal procedures.

These issues deserve careful and independent review before any American citizen is surrendered to a foreign government.

Andrew and Tristan Tate are citizens of the United States.

They have not been charged with any crime in the United States.

Regardless of anyone's opinion about them, American citizenship carries constitutional protections that should not be diminished because an individual is controversial.

The United States has a duty to ensure that every extradition request complies with our laws, our Constitution, and the principles of due process.

Andrew and Tristan Tate also have active civil litigation pending in Florida against individuals they allege made false and defamatory statements that contributed to the Romanian investigation.

to take the following actions before any extradition is permitted.

 
1. Suspend the Extradition
We respectfully request that the United States Government halt any extradition of Andrew and Tristan Tate until all legal questions have been fully reviewed.

 
2. Respect the Romanian Court's Prior Decision
We request that the United States give full consideration to the Romanian court's March 2024 order delaying any surrender to the United Kingdom until the Romanian criminal proceedings are concluded.

Supporters believe this prior judicial decision should receive careful consideration before any transfer from the United States is approved.

 
3. Order an Independent Legal Review
We respectfully request that an independent legal review be conducted before any extradition decision is finalized.

That review should examine:

the handling of the UK prosecution,
the relationship between the Romanian and UK proceedings,
compliance with applicable treaties and international legal obligations,
the protection of American citizens' constitutional rights,
and whether extradition is appropriate under the circumstances.
The American people deserve confidence that justice—not politics—is guiding every decision.

 
4. Allow the Florida Civil Cases to Proceed
Andrew and Tristan Tate currently have pending civil litigation in Florida against individuals they allege made false and defamatory statements.

We respectfully request that these legal proceedings be allowed to continue without unnecessary interference and that their existence be considered as part of the overall legal context before any extradition decision is made.

 
5. Ensure Fair and Humane Treatment During Detention
Andrew and Tristan Tate have not been convicted of any crime in the United States.

While they remain in federal custody, we respectfully request that they be treated fairly, humanely, and consistently with the Constitution, federal law, and Bureau of Prisons policies.

If they are being housed under restrictive conditions, including the Special Housing Unit (SHU), we ask that those conditions be reviewed to determine whether they are necessary and appropriate under Bureau of Prisons policy.

Pretrial and extradition detainees should not be subjected to punitive conditions before the completion of legal proceedings.

 
6. Allow Release on Reasonable Conditions
We respectfully request that the federal court consider allowing Andrew and Tristan Tate to be released pending the outcome of extradition proceedings under appropriate conditions, including:

A secured bond;
Home confinement;
Electronic monitoring;
Surrender of passports;
Any additional conditions the Court deems necessary.
Supporters point to factors they believe favor release, including that the brothers are U.S. citizens, have not been charged with crimes in the United States, and have participated in legal proceedings over several years while maintaining their innocence.

We ask that the Court consider the least restrictive conditions consistent with the law and the interests of justice.
