
We’ve received word from the Deputy City Manager of Midland that a code enforcement officer visited the construction site on Tuesday, June 24th and determined the builder/contractors are “in compliance.”
But the homeowners of Pavilion Park strongly disagree.
The so-called dust control barriers—short, unsecured strips of material—have only been placed on a small section along the southwest side of the site. The entire north side remains unprotected, which directly exposes our homes to continued dust intrusion, property damage, and serious health risks.
This is not environmental compliance. This is performative.
We continue to believe that multiple City of Midland Code Ordinances are being violated, including but not limited to:
- Public Nuisance
- Unsanitary Conditions
- Lack of Construction Site Maintenance
- Erosion and Sediment Control Failures
- Air Quality Violations
Our families are still living with orange dust on their vehicles, inside their homes, and in their lungs. If this is "compliance," the standard is far too low.
