Dear City of Midland Officials, Environmental Health Department Personnel, and Code Enforcement Teams,

My name is Amy May, and I reside in Pavilion Park, Midland, TX. I am writing on behalf of myself and numerous concerned homeowners in our neighborhood regarding severe and ongoing issues caused by a housing development currently under construction directly adjacent to our community. The site is generating excessive airborne dust, creating hazardous conditions that significantly impact our health, homes, and overall quality of life.

Health Hazards

Residents are experiencing worsening respiratory symptoms, and outdoor activities have become unsafe due to the intense dust exposure. The following health impacts are of urgent concern along with potential loss wages from work:

  • Respiratory Issues: Fine dust particles can lodge deep in the lungs, triggering asthma flare-ups, sinus infections, bronchitis, lower respiratory infections, chronic obstructive pulmonary disease (COPD), and potentially pulmonary fibrosis—especially in children and older residents.
  • Cardiovascular Risks: Inhaled particles may enter the bloodstream, heightening the risk of heart attacks, strokes, and arrhythmias, particularly among those with existing heart conditions.
  • Eye and Skin Irritation: Frequent irritation, redness, dryness, and dermatitis are being reported, especially among sensitive individuals.
  • Infection Risk: Dust-borne contaminants increase the chances of sinus, ear, and respiratory infections.
  • Emotional and Mental Wellbeing: The inability to enjoy our outdoor spaces and ongoing home maintenance challenges are affecting residents' mental health, sleep quality, and daily peace of mind.

Property Damage & Financial Burden

The damage to property is constant and costly:

  • Homes, garages, and vehicles are coated daily in orange-tinted dirt.
  • HVAC filters must be replaced frequently—far more than typical seasonal maintenance.
  • Lawns and landscaping are buried beneath dust, resembling sand dunes in some areas.
  • Pools are unusable; one resident reports their filter is now clogging monthly instead of twice a year, requiring added maintenance and expense.

Additional impacts could include:

  • HVAC and AC System Overload
  • Clogged gutters and roof damage
  • Degraded seals around doors and windows
  • Fading or staining of exterior surfaces
  • Blocked irrigation heads and plumbing
  • Damaged outdoor electronics (cameras, sensors)
  • Soil erosion and long-term landscaping degradation

Environmental Negligence

It appears the construction site is operating without proper environmental safeguards in place and may be in violation of local and state regulations.

Attempts to Resolve

  • Vicente Carrasco, owner of Carrasco Homes, LLC / 3 Centavos, LLC, has been contacted but denies his company is responsible for the project.
  • Many residents have submitted complaints via the SeeClickFix app, which have been prematurely marked as “resolved,” despite no improvement or action taken.

We feel unheard, unprotected, and increasingly burdened by this ongoing issue.

Request for Immediate Action

We respectfully request the City of Midland and its departments to:

  1. Investigate the builder’s environmental compliance, including Carrasco Homes and its affiliates.
  2. Enforce applicable ordinances and construction regulations.
  3. Require immediate implementation of dust control methods such as water suppression and wind barriers.
  4. Reopen and actively address unresolved SeeClickFix reports to ensure transparency.

  • §111.111 – Exceeding emissions or visible particulate standards
  • §111.119 – Failure to use dust suppression measures

Texas Clean Air Act (Health & Safety Code Ch. 382)

  • §382.085 – Prohibiting unauthorized emissions that affect health or comfort
  • §382.0518 – Requiring permits for construction-related air contaminants

We are also exploring the option of filing a class action lawsuit against Carrasco Homes, LLC/3 Centavos, LLC for negligence, private nuisance, violation of local ordinances and environmental codes, trespass (airborne particulate intrusion), medical damages, along with lost wages, and property loss.

Our goal is accountability, environmental responsibility, and the swift restoration of a safe, livable community environment.
