The Issue

Without a single vote in Congress, the Trump administration may be on the verge of banning abortion nationwide — and most Americans have no idea it's happening.

At his Senate confirmation hearing, Attorney General nominee Todd Blanche committed to reviewing a Biden-era legal memo that currently protects the right to mail abortion pills across state lines.

The tool he's eyeing: the Comstock Act, an 1873 law written to ban "obscene" materials through the mail.

Anti-abortion activists have spent years arguing the government can use this dusty statute to criminalize shipping mifepristone, the most common abortion medication in the country, effectively ending medication abortion in all 50 states without ever passing a law.

This isn't a hypothetical.
