Moon Dancer Winery Continues Fight for Survival

Owner: This isn’t just about my winery; this is about my constitutional rights’

WRIGHTSVILLE, Pa. – Moon Dancer Winery remains open for business as it continues its legal fight, filing a request for re-argument with the Superior Court of Pennsylvania last week.

In its filing on June 18, Moon Dancer Winery requests the court allow re-argument to reconsider the decision and allow it to remain in operation, due to the court’s misunderstanding or misinterpretation of the arguments in the case.

Moon Dancer noted in its filing that the court “misunderstood three fundamental positions of Moon Dancer,” including a key argument that the winery’s fundamental right to due process was lost due to the alleged “fraudulent concealment” and “malfeasance” of its former legal counsel.

Those alleged actions by Moon Dancer’s previous legal counsel “caused extraordinary circumstances resulting in the deprivation of its constitutional right to due process.” 

The filing noted that a court hearing should have been held to confirm the “fraudulent concealment” and “malfeasance” allegations against its former attorney, but that did not happen – which further deprived Moon Dancer of its constitutional rights to due process.

Lastly, Moon Dancer stated that the Superior Court noted in its recent opinion that the winery’s court filing was filed 10 months after the neighbors moved to close the winery. However, Moon Dancer argued that its court documents asking the lower court for a chance to respond were filed nine days after it learned of the decision that initially closed the winery. The winery argues that met the relevant deadline for timely filing and said its failures to respond earlier were caused by the alleged “fraudulent concealment” committed by the winery’s previous attorney.

“Over the course of nearly five years, our prior legal counsel withheld information and failed to inform us of critical information in this case – including sanctions, an award of attorneys’ fees and important court rulings,” said Jim Miller, owner of Moon Dancer Winery. “The fraudulent concealment and malfeasance by our previous attorney deprived us of our due process rights under the Pennsylvania and U.S. constitutions.

“This isn’t just about my winery; this is about my constitutional rights and the rights of every citizen to due process under the law,” he added. “I hope the Pennsylvania Superior Court sees this case for what it is – a true constitutional issue that requires reconsideration and an opportunity for us to finally have our arguments heard in court.”

Previous court rulings allowing the winery to continue operations while litigation continues remain in effect.

Moon Dancer Winery is located on picturesque farm property on Klines Run Road, overlooking the Susquehanna River. The winery’s hours of operation arenoon to 5 p.m. on Wednesdays and Thursdays, noon to 10 p.m. on Fridays, and 11 a.m. to 6 p.m. on Saturdays and Sundays.

The winery will host its annual Reds, Whites & Blues Festival on Saturday, July 5, with tickets available for purchase online. In addition, Moon Dancer is set to host its annual Reggae Festival on July 26-27, with those tickets available online starting July 1.
