New York State Police Press Release 3/17/20:

Clermont, New York – On March 17, 2020, the New York State Police in conjunction with the Columbia County District Attorney’s Office arrested Andrea Nussinow, age 57, of Clermont, for thirty-five counts of Agriculture and Markets Law section 353 the overdriving, torturing and injuring animals, and/or failure to provide proper sustenance, an unclassified misdemeanor.

The Supporters of “STOP the Animal Cruelty in Columbia County, New York” respectively ask Paul Czajka, District Attorney of Columbia County, New York when he plans on prosecuting Nussinow for 35 counts of Animal Cruelty?

After years of complaints filed by the public against Nussinow for animal cruelty dating back to 2014, supported by the testimony of dozens of credible witnesses, expert testimony, photos, videos, and “live” and “dead” animals, Paul Czajka, District Attorney needs to fully prosecute this case to send a clear message that Animal Cruelty is against the law, as well as hindering investigations, providing false statements, and obstructing justice.

By way of background, the New York State Police arrested Nussinow in 7/2017 for 11 counts of Animal Cruelty. Subsequently, Paul Czajka, District Attorney for Columbia County convened a Grand Jury to review the charges. The ADA assigned to prosecute the case “botched the Grand Jury Hearing” by only presenting 4 of 11 charges, withholding credible witnesses and expert testimony, and other key evidence for the prosecution. This incomplete presentation of the facts and evidence by the prosecution misled the Grand Jury and resulted in the Grand Jurors voting not to indict Nussinow.

We are confident Paul Czajka, District Attorney will fully prosecute and convict Nussinow for Animal Cruelty this time to protect the animals, and to avoid the appearance of misconduct by the District Attorney’s Office to benefit Nussinow, a N.Y. Thoroughbred Breeder. The failure of the District Attorney’s Office to prosecute Nussinow, could also “trigger” the intent to commit insurance fraud against the County of Columbia (the County) , Columbia Greene Humane Society (CGHS ), and CGHS  employees Ron Perez, President and Lee DeLisle, Animal Cruelty Investigator by Nussinow.

In 3/19 Nussinow and her attorney filed a multi-million-dollar Federal lawsuit against the County, CGHS, Perez and DeLisle claiming false arrest, malicious prosecution, and damages stemming from her arrest in 2017. Just because the prosecution failed to indict Nussinow in 2017, does not erase the fact and supporting evidence on file that dozens of animals, including Nussinow’s personally owned horses,  privately owned Thoroughbred’s, rescue horses Nussinow obtained by misrepresenting the care that would be provided, and a host of other farm animals that suffered severe neglect, torture and starvation at Blue Star Thoroughbred Breeding Farm in 2017.

Between 12/2017-12/2019 the public continued to file complaints with the authorities re: the ongoing Animal Cruelty violations at Blue Star Thoroughbred Breeding Farm with supporting evidence, but once again, CGHS, the lead Animal Cruelty Investigative Agency appeared to continue to “hinder the investigation” of the Animal Cruelty violations, or enforce New York State laws prohibiting animal cruelty at Blue Star Thoroughbred Breeding Farm  

On 1/2/20, the New York State Police seized over 38 animals from Blue Star Thoroughbred Breeding Farm that were suffering from severe neglect, starvation, and other maladies. Many of the horses required immediate medical attention and a careful refeeding program to try and save their lives. Several of the neglected horses, including Thoroughbred mares and foals suffered for two additional years until they were saved by the New York State Police, Godspeed Hostel & Horse Rescue and several volunteers. Sadly, several of the badly neglected horses were Thoroughbred mares and foals. These critically ill horses were later identified as Thoroughbred’s Nussinow purchased at the Fasig Tipton Saratoga Fall Sale held October 2017, during the court ordered “seize in place” after Nussinow’s previous arrest for Animal Cruelty 7/2017, in brazen Contempt of Court. CGHS, the lead Animal Cruelty Investigative Agency with a court ordered oversight of the animals during the “seize in place” court order was advised of Nussinow’s contempt of court but failed to additionally charge, or re-arrest Nussinow. The failure of CGHS to provide any meaningful “oversight of the animals”, or enforcement of a court issued “seize in place” order seems to demonstrate a clear pattern of favorable bias shown towards Nussinow by CGHS, and their failure to enforce the NYS laws against Animal Cruelty at the expense of the suffering animals.

This Animal Cruelty case has volumes of supporting testimony and evidence of the animal cruelty crimes that occurred at Blue Star Thoroughbred Breeding Farm between 2014-2020 on file with multiple state and federal agencies, despite Nussinow’s “gaslighting” attempts to deflect her responsibility to create confusion.

The People strongly object to the County and CGHS, and their insurance carriers from rewarding Nussinow for years of injuring, torturing, and starving the animals at Blue Star Thoroughbred Farm by “paying” her for the heinous crimes committed against the defenseless animals. If Paul Czajka, District Attorney fails to prosecute and convict Nussinow, it may trigger a confidential financial settlement with Nussinow, with the intent to defraud the Government and Taxpayers. Until the case is adjudicated, the Taxpayers request Attorneys representing the County, and its agent CGHS file a Motion to be reimbursed for all legal fees and expenses incurred defending themselves against Nussinow’s lawsuit in the event she is unsuccessful defrauding the Government.

In conclusion, 43,875 Supporters of “STOP the Animal Neglect in Columbia County, N.Y.” would like to thank Paul Czajka, District Attorney of Columbia County, N.Y. and to be advised when he is going to finally “prosecute” Nussinow after years of abusing dozens of animals, including Thoroughbred mares and young foals, and disallow the County and CGHS in "paying" a fraudulent insurance claim against the Government by Nussinow at the expense of the taxpayers and the suffering of animals.
