In 2018, Michigan voters decisively chose to legalize and regulate marijuana through a ballot initiative—not through backroom deals or rushed legislation. Now, that decision is under threat.
Governor Gretchen Whitmer and the Michigan Legislature recently passed a new 24% wholesale tax on marijuana, buried in a road-funding bill that was rewritten and fast-tracked without public hearings. This tax is not only harmful to small cannabis businesses and consumers—it’s potentially unconstitutional.
The Michigan Cannabis Industry Association has filed a lawsuit arguing that this tax violates the 2018 voter-approved marijuana law, which already established a 10% excise tax and set clear rules for how marijuana revenue should be distributed. Any change to that law should require a public vote or a three-quarters supermajority in both chambers of the Legislature—not a last-minute rewrite passed on a party-line vote.
This tax isn’t just a financial burden—it’s a direct challenge to the will of the people. Experts warn it could fuel the black market, make legal products less accessible, and drive small dispensaries out of business, all while failing to deliver on the promised $420 million in road funding. If sales decline due to higher prices, the tax could raise far less than projected, hurting everyone involved.
We demand that Michigan lawmakers respect the democratic process and halt the implementation of this new tax. The Comprehensive Road Funding Tax Act should not be used as a Trojan horse to rewrite marijuana policy behind closed doors.
