The Issue
Title: Parental Responsibility Act
Section 1: Purpose
The purpose of this legislation is to establish parental responsibility for the actions of their child(ren), both within and outside of educational settings, and to provide consequences for failure to uphold this responsibility.
Section 2: Parental Fines for Unruly Behavior
(a) For incidents of unruly behavior occurring at the elementary school level, parents shall be subject to fines starting at $25.00 for each occurrence, increasing by $25.00 for subsequent occurrences, regardless of whether the child is in school at the time of the occurrence.
(b) For incidents of unruly behavior occurring at the junior high school level, parents shall be subject to fines starting at $50.00 for each occurrence, increasing by $50.00 for subsequent occurrences, regardless of whether the child is in school at the time of the occurrence.
(c) For incidents of unruly behavior occurring at the high school level, parents shall be subject to fines starting at $100.00 for each occurrence, increasing by $100.00 for subsequent occurrences, regardless of whether the child is in school at the time of the occurrence.
(d) If law enforcement becomes involved in any incident of unruly behavior, an additional fine shall be enforced on the parents.
Section 3: Payment and Enforcement
(a) Payment of fines is due within 10 business days of the occurrence. Failure to pay fines within the designated timeframe may result in wage garnishment.
(b) If a child is required to wear an ankle monitor, the parent(s) shall also be required to wear an ankle monitor at their own expense, to be paid via wage garnishment.
(c) In the event that an individual 18 years old and younger causes the death of another individual, regardless of the victim's age, the parents of the perpetrator shall be responsible for reimbursing the deceased family members for funeral expenses, to be paid via wage garnishment.
Section 4: Curfew Violations
(a) If a teen is found to be out past curfew, a fine of $50.00 shall be enforced, increasing by $50.00 for subsequent occurrences.
(b) Payment of curfew violation fines is due within 10 business days. Failure to pay fines within the designated timeframe may result in wage garnishment.
Section 5: Implementation and Enforcement
(a) Educational institutions and law enforcement agencies shall collaborate to document incidents of unruly behavior and curfew violations and to enforce fines.
(b) Any disputes regarding fines or enforcement shall be adjudicated through the appropriate legal channels.
Section 6: Severability
If any provision of this Act is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Section 7: Effective Date
This Act shall take effect immediately upon approval and shall apply to incidents occurring on or after that date and 6 months prior to.
