Yesterday, someone other than ourselves, submitted a code violation to the City of Albany, AGAIN, for this property not having a ROP (Rental Occupancy Permit). This property was purchased by Nori Uruga AKA Blue Sky Property Management in March 2024. At that time the ROP with emergency contact information was the previous owner's. City Code requires the ROP to be updated and or renewed when ownership changes. The response from Albany BRC (Buildings & Regulatory Compliance) is surprising and alarming:

Thank you for reporting this incident. A Code Enforcement Officer has performed an inspection of the premises and has determined that this will be cited at the ROP inspection scheduled in May.

Don't they get a fine for each day they rent a unit without an ROP? I know for a fact side A has a long term contract tenant there now and side B is listed and rented on Airbnb and has been since the ROP expired.

(Note: ROP under previous owners name expired March 2026.)

As long as the ROP is scheduled, they are not in violation.
 

(Note: ROP is scheduled because they received a SWO (Stop Work Order) for the expired ROP)

The current ROP has the previous owner's information, the property was purchased by Blue Sky Vacation Properties two years ago. How are they not in violation? Last time I bought a rental unit the ROP had to be updated, signed, and submitted at closing. I guess a lot has changed in Albany in the past 12 years.

Nothing has changed. When the new owners purchased the property, the ROP was still valid. The new owner then submitted the Rental Dwelling Form to schedule a new ROP inspection. Since we are scheduling 40 days out, the current ROP remains valid until the new inspection in May.

(Note: Property ownership changed March 2024, new owner submitted a RDF to schedule an inspection in March 2026 only because they received a SWO. They've been operating without an updated ROP for 2 years.)

If a LLC buys a rental they get to bend the rules, everyone else has to follow. Got it. Thanks for the clarification. I'll be sure to incorporate before buying any more property in Albany (hint: I will never) ROPs are non-transferable. §231-142 "Change in registration information". Why would BRC require two contacts listed on the ROP, that can pick up the phone and answer to an emergency within 30 minutes, if the contact information doesn't even have to be updated. Side note: A quick search of your database shows that Blue Sky manages DOZENS of units in Albany. It also looks like the owner has a chronic problem with "forgetting to register". I was going to just let this go, but now I feel obligated to follow up with Valerie.

(Note: This property manager operates under 5 different LLCs that I know of from Freedom of Information Act.)
