Stop Quebec's Judicial Silencing: Demand protection for human rights claimants

The Issue

Imagine dedicating years to fighting systemic racism, winning a historic $44,000 human rights endorsement against police harassment, and then having a judge strip it all away while banning you from ever complaining about discrimination again.

Thanks to The Hon. Justice Catherine Piché's judgment against Raymond Samuels on May 27, 2026 , this is the terrifying reality which now faces all future human rights claimants across Canada.

In a shocking and regressive ruling, Quebec Judge Piché declared Mr. Samuels a “vexatious litigant” simply for standing up  against racial profiling by the Gatineau Police, which was confirmed by the Government of Quebec's own human rights commission (Commission des droits de la personne et des droits de la jeunesse - CDPDJ).  Vexatious litigant status basically strips away your right to apply to a court for judicial relief in a court of law, and as a result, makes you vulnerable to being attacked by anyone (or group) who seeks to take advantage of your status by subjecting you to various wrongdoings against your rights or property.

Instead of upholding accountability, Judge Piché's dictatorial ruling has now set a terrible negative judicial precedent for anyone across Canada who seeks to stand up against human rights abuses of any kind.

Judge Piché in an unhinged tyrannical ruling against both the Quebec Charter and the Canadian Charter of Rights and Freedoms went so far as to even ban Mr Samuels from complaining about her to the Canadian Judicial Council and elsewhere which is completely illegal. 

Judge Piché endorsed Gatineau Police lawyer Mathieu Daponté's position that it was "not nice" for Mr. Samuels to have accused the Gatineau Police of racism in order to support their position that Mr.  Samuels should be stripped away of his civil rights as a "vexatious litigant".

This is a devastating abuse of power that mirrors Jim Crow-era tactics in American history. If a judge can legally strip away a citizen's right to report human rights abuses including racism and protect their community, then no one is safe.

We cannot allow judicial bias to protect police misconduct and silence the voices fighting for marginalized communities.

Our Demand: We call on the Canadian Judicial Council, the Attorney General of Canada (Piché was appointed by the Minister on October 11, 2022), the Quebec Ministry of Justice to immediately investigate Judge Piché’s ruling, protect the right to expose racial profiling, and restore Raymond Samuels’ fundamental human rights to champion the public interest toward a just society for all.
