STOP OVERDEVELOPMENT OF WOOLLARHA AND DA455
The issue
The Woollahra Residents' Association, Inc. is a not for profit incorporated association dedicated to the protection of the heritage and historical character of Woollahra, the safeguarding of the community against excessive and / or illegal development and the maintenance of resident and visitor amenity for the benefit of the whole community.
DA455/2021 on 364A Edgecliff Road is a proposal to develop a 6 storey residential flat building in the heart of the Woollahra Heritage Conservation Area. It endangers the surrounding heritage contributory properties and represents a gross overdevelopment of the site which prioritises only developer profit and destroys community amenity. The proposal is severely non-compliant against the applicable development controls, including by being in breach of:
1. the applicable 2 storey height control by 300%;
2. the applicable floor space ratio control by 191%;
3. the applicable building separation control by 400%;
4. the applicable setback control by 500%; and
5. a host of other development controls and objectives which apply to the Woollahra Heritage Conservation Area including in relation to parking, private open spaces, sunlight, privacy, landscaping and heritage matters.
Although the proposal is manifestly and severely non-compliant with the controls, the applicant has repeatedly sought to ignore that and has falsely claimed it is compliant. The only assumption logically made by the applicant's conduct is that it is attempting to brazenly mislead and deceive the community.
By any stretch, the proposal represents the high water mark of developer greed, overreach and deceit.
The local planning panel has refused the proposal and the applicant has now gone to the Land and Environment Court to seek approval. If it continues to claim its proposal is compliant before the Court it will be actively attempting to mislead the Court in the same way as it has attempted to mislead the community.
If this proposal were to be approved it would set a terrible precedent for greedy developers prepared to falsely claim compliance while seeking approval for developments which breach the building controls by, literally, hundreds of per cent. That would inflict a terrible injustice on the community.
The community is counting on the Court to refuse this application on the basis of the severe non compliances referenced above on crucial controls including height, FSR, building separation and setbacks.
