Petition for Appeal of Sentence - Cory DeVaughn Foster
Dear Judges Kearney of PA and Andrews of District Court of DE
We formally request an appeal regarding the court's decision to impose a 67 ½ year sentence on Cory DeVaughn Foster in relation to the charges he faced. We submit this petition with a deep sense of remorse for the actions that led to his convictions and a sincere belief that this sentence warrants reconsideration based on several critical factors that highlight an unjust disparity in the punishment rendered.
Nature of the Charges:
Cory DeVaughn Foster was convicted of three robberies committed with the use of a firearm. We acknowledge the seriousness of these offenses, it is imperative to recognize Cory's genuine remorse for his actions. He understands the impact of his decisions and is committed to making amends, demonstrating a desire to reform and contribute positively to society.
Existing Sentences and Time Served:
The 67 ½ year sentence appears excessively disproportionate when considering that Cory has already served 10 years of this sentence. This lengthy incarceration raises significant questions about fairness and equity in sentencing, particularly when evaluated against the nature of the offenses committed and his race.
Brandishing a Firearm:
The conviction includes seven counts of brandishing a firearm. While these charges must be taken seriously, I urge the court to consider the cumulative impact and the potential for concurrent sentencing. The current sentence compounds the overall punishment to an unjust degree, overshadowing the potential for rehabilitation.
Health Considerations:
Cory has relatively recently been diagnosed with multiple sclerosis, a debilitating condition that significantly affects his quality of life. He is receiving subpar treatment currently, this health issue is a substantial factor in reconsidering his sentence, as it hampers his ability to endure the rigors of incarceration and leads to further complications regarding his health and well-being.
Rehabilitation:
Cory has expressed a strong desire to rehabilitate and is actively seeking opportunities for personal growth and change. His time in prison has provided him with a chance to reflect on his mistakes, and he is eager to participate in programs that foster rehabilitation. Reducing his sentence would allow him the opportunity to reintegrate into society and contribute positively, rather than remaining incarcerated for an excessive duration of time that undermines his potential for change.
Gross Disparity in Sentencing:
The 67 ½ year sentence reflects a gross disparity when compared to similar cases.
We urge the court to consider the principle of proportionality in sentencing, which is fundamental to a fair and just legal system. Given these considerations, We request that the court review the decision regarding Cory DeVaughn Foster's sentence. An adjustment/reduction in the term of incarceration would serve the interests of justice, equity, and rehabilitation.
Please sign and help us get Cory a reduction in sentencing and sent home to live out his right to a second chance and receive better treatment for his condition of MS. We thank you in advance!
