Stop Over Billing by the Las Vegas, New Mexico Utilities Department

The Issue

Mayor Trujillo, this petition is to make you aware that there is a problem in the City of Las Vegas, New Mexico.
There are several Las Vegas, New Mexico Utilities Department customers that are being or have been charged in the past few years with ridiculously high water consumption,  resulting in water bills in the hundreds and thousands of dollars.  These water bills exceed normal monthly water consumption amounts, in some cases, anywhere from ten to greater than a thousand times normal water consumption by a customer with no explanation. 
Based on the number of customers receiving these outrageous bills, we believe there is not only a problem with the water meters (faulty meters and/or the installation causing the meters to be faulty and record ridiculously high water consumption) but also a problem with the Director of the Utilities Department, Maria Gilvarry.
Maria Gilvarry’s lack of customer service and her failure to acknowledge that there is a problem and act upon numerous complaints by customers has eroded all public confidence in her ability to perform the duties required of the Director of Public Utilities Department.
 
We the undersigned are demanding:
·      An audit of the Las Vegas Utilities Department to determine and disclose:
o   All water meters reporting exaggerated water consumption
o   All instances where water consumption irregularities were reported to the Utilities Department/Water Department
o   The actions or lack of action taken by the Utilities Department/Water Department to correct reported water consumption irregularities.
o   Any/all irregularities with the contract to purchase/install/maintain the water meters by/with the Las Vegas, New Mexico Utilities Department/Water Department
o   Review of customer accounts and financial pardons and/or refund for amounts billed and/or paid (since time of installation of faulty meters, which is believed to be anywhere from 5-7 years ago to present) to said customers in excess of normal monthly water consumption
·      The repeal of City Ordinance 440-16 which makes the customer responsible for the cost of water meter testing
·      Contact with the water meter manufacturer/supplier to determine how/why and what can be done about meters spinning out of control recording excessive water usage
·      The immediate (accurate) testing of the city water meters by a qualified independent party to provide
o   Verification that installation and accounting standards have been met
o   Verification that spinning, air, pressure changes, cross contamination, wells and outside conditions (magnets, construction, water mains, fire hydrants etc.) are not affecting the meter operation  
·      If needed, the replacement of the city water meters by a qualified independent party at no cost to the customer
