The developer is asking the City for exceptions to 3 zoning codes/building regulations because he acknowledges cannot comply with them. These are in the areas of (1) lack of required retail space, (2) insufficient habitable space on the first two floors and (3) trash handling. He is also likely going to need to request a 4th exception regarding insufficient facades on the front of the building.
This doesn't even include the (1) blatant abuse of interstitial space to gain building height and charge premium prices for condos with a water view (on property that's not on the waterfront) (2) lack of compliance to the Compatibility criteria in the Zoning Code and Downtown Sarasota Master Plan with regard to building height and scale and (3) counting 6 stories of parking as only 3 stories in order to gain height and "comply" with the 18 story limit.
For this reason, we are saying "No Exceptions for the Obsidian".
