
2/20/2026 Update:
The Special Board of Appeals meeting on 2/19/2026 was held to determine the validity of our appeal based on timeliness, substance, and our standing to make such an appeal. Thankfully the Board ruled to accept the appeal, which will now be fully presented during a formal hearing that will be open to the public.
This is not a victory towards a decision, but one that allows us the opportunity for our case to be heard. We have a dog-in-this-fight so to speak. Now is the time that will demand the most commitment, effort, and donation support from the community. As most witnessed last night, in-person or through the city’s portal, the type of quality we retained to represent us as citizens. The moral and ethical integrity of attorney Joe Cincotta, as well as his level of knowledge and professionalism, was on full display and ultimately resulted in a favorable ruling despite the odds. Please pledge your support through our go-fund-me, so that we can continue to fight for the rights and best interests of the citizens of the city of New Berlin.
The next action will be a formal Board of Appeals hearing to rule on the nature of our appeal. This will be the most significantly important event to date in regards to this matter. The date is currently TBD, but is expected within the next few weeks.
To address the misconceptions some might have regarding our appeal: We are not opposed in any way to drug-addiction rehabilitation or the Milwaukee Rescue Mission as an organization. Most within the NBCU, UA have experienced loss and/or hardship as a result of addiction. We wholeheartedly believe that such facilities can and should exist. However, considering the impact of such programs, careful city planning is required and the development must lawfully adhere to proper building and zoning codes. These zones are specifically created to ensure public safety, security, prosperity, in which all proposals, regardless of entity type, must comply.
