This is the 421-a Rider Gotham is pushing on tenants. It directly conflicts with our original 2013 LIHTC/HFA lease rider. Key issues: • LIHTC/HFA agreements are separate from 421-a tax benefits — yet Gotham is using this rider to erase those protections. • Rider claims all protections end in 2034/2036, forcing tenants to agree they lose renewal rights guaranteed under Rent Stabilization. • Tenants are also forced to accept automatic 2.2% annual rent hikes starting July 2026 — years before benefits expire. • By signing, tenants unknowingly waive their tenancy rights and agree to future rent increases. • Gotham withholds countersigned leases unless this rider is signed — and hides it inside DocuSign packages so seniors, disabled tenants, and others are tricked into self-eviction. This is deceitful exploitation of subsidies Gotham accepted.
