• 35-year affordability: “This unit will remain restricted for the first 35 years.” • Renewal rights: “ANY ELIGIBLE TENANT SHALL BE ENTITLED TO REMAIN IN OCCUPANCY AND OBTAIN A RENEWAL LEASE IN ACCORDANCE WITH THE RENT STABILIZATION CODE … NO EVICTION EXCEPT FOR GOOD CAUSE.” • Rent limits: “Rent upon lease renewal shall not exceed allowable Rent Stabilization increases.” • This rider controls: “If there’s any inconsistency, this Rider supersedes other lease riders.” Why this matters: these terms conflict with the 421-a rider Gotham is now pushing on in-place tenants. Gotham has withheld countersigned leases when tenants decline that rider and used it to pressure tenants to give up protections. Gotham’s own email (1/27/22) to another tenant states: “you may return the lease with the rider unsigned.” Next update: I’ll post the 421-a rider with a point-by-point list showing how it contradicts the original lease.
