Stop EB Games' Price Gouging of Pokémon TCG Products in Australia

The issue

EB Games Australia is selling Pokémon's 30th Anniversary TCG products between 60%-100% over above the official RRP, despite being one of the only preorder channels available, and during a cost-of-living crisis. This behaviour is exploitative and breaches the Australian Consumer Law principles around misleading conduct and unconscionable pricing. 

We, the Australian Pokémon community, collectors, parents and hobbyists call on EB Games Australia to immediately cease its excessive price inflation of Pokémon TCG 30th Anniversary collection products.

EB Games is currently listing items such as the Ultra Premium Collection at $599, 66% higher than $360 at JB Hi-Fi;  Elite Trainer Boxes are listed at $199, nearly double the $110 at JB Hi-Fi; and the Binder Collection sold at $129 vs $65 at JB Hi-Fi; as a few examples along with all other items in this collection sold at almost double the industry standard. This is evident price gouging, especially when EB Games is one of the only preorder channels available.

EB Games also requires customers to purchase a $49 EB World membership to access Pokémon TCG pre-orders, yet members are still faced with heavily inflated prices for above official RRP. Charging a fee for "priority access" only to offer products at gouged prices is unfair and undermines the value of the membership itself. 

We believe this behaviour contradicts Australian Consumer Law, such as misleading and deceptive conduct (ACL s18), false or misleading representations (ACL s29) and unconscionable conduct. 

Pokémon TCG is a beloved hobby for people of all ages. It should not be exploited for extreme, scalper-levels of profit and inflated pricing, especially in a cost-of-living crisis. The 30th Anniversary set is meant to be a celebration of Pokémon's legacy, not an opportunity for major retailers to exploit demand. Price gouging undermines the spirit of the hobby and the principle of fair access.

We call on EB Games to:
1. Immediately adjust pricing of the 30th Anniversary set to align with or close to RRP; and provide refunds or lower the outstanding balances of orders paid only with a deposit.
2. Provide transparency on pricing decisions.
3. Refund paid EB World memberships for customers who purchased it solely to access Pokémon TCG pre-orders that were then listed at inflated pricing.
4. Commit to fair and ethical pricing practices going forward.

We call on the Australian Competition and Consumer Commission (ACCC) to enforce and uphold the above requests. 

We ask the ACCC, Pokémon Company International and the broader TCG community and supports to support this petition and stand against exploitative pricing in the Australian retail market.
