STOP BIRD BOMBING PERMITS FOR EXPLOSIVE PEST CONTROL DEVICES

The Issue

The bird bombs fired at migrating birds inside the city limits of Johnson City near 8th Ave/Oakland Ave are illegal. Explosive Pest Control Devices are regulated by the Bureau of Alcohol, Tobacco, Firearms & Explosives & contain hazardous, flammable, explosive materials LIKE fireworks which are outlawed inside the city the limits. EPCD's are used in agriculture, aquaculture & aviation, none of which are in the vicinity of the shooter. Wynn Wildlife Rehab in Stoney Creek stated that birds are full of air sacs; the explosive concussion can damage hearing & shock the birds to death. This travesty is disruptive to the elderly, children and domestic pets within MANY blocks of this "legal" use of explosive devices to destroy natural wildlife in its migratory pattern. The entire neighborhood for BLOCKS is being terrorized by the ONE PERSON inside the city with a "permit" to use explosives to damage innocent migrating wildlife. Please act to protect our neighborhood and wildlife. The shooter is storing and detonating explosive materials by "permit" of the City putting the City in a position of liability for fire and personal injury of other city inhabitants.

Ordinance 11-139 in Johnson City Municipal Code states:

(1) It shall be unlawful for any person to sell or offer for sale, or keep in stock, or give away, within the city, or one (1) mile thereof, any firecracker, cannon cracker, torpedo, Roman candle, sky rocket, pin wheel or any fireworks of any nature whatsoever, or any toy pistol or toy cannon, discharged by percussion caps by percussion caps and gunpowder or other means.

(2) No person shall sell, possess or use fireworks of any description within the city; provided, that this section shall not apply to wholesale dealers and jobbers who may possess fireworks for sale to merchants; provided, further, that this section shall not apply to fairs, shows and exhibitors who desire to give fireworks displays for the amusement of the public; provided, that such displays shall be given under the joint supervision of the exhibitor and the city police department so as to protect the health and welfare of the public, but no such fireworks display shall be given without a permit from the city recorder.
