Today is the day for worship of Lord Siva as part of Thiruvathira. In other parts of India, lakhs of devotees worship Lord Siva without harming Elephants. But in Kerala, torturing Elephant is a part of festivals. The video and photograph enclosed herewith is the proof of abusing Elephant as part of Thiruvathira festival. Actually the pulling of big Chariot is a show of human strength and team spirit. But in Kerala, especially in Palakkad District some temple festival organizers use Elephant under scorching sunlight to push the chariot violating all the provisions of the Wildlife Protection Act 1972 and PCA Act 1960. The Ayaloor Akhileswara Temple festival committee violated the Supreme Court Order in 18th August 2015, by using Elephant for pushing the biggest and heaviest chariot in Kerala.  Eventhough we had lodged complaint in this regard on 24th December 2015 to Palakkad District Collector, Palakkad District and Palakkad Assistant Conservator of Forest of Social Forestry Department, all of them remain mum. Today, from 11.30 noon the Elephant was tortured there to push the chariot under scorching sunlight. The Supreme Court had issued strict orders to Kerala State Government to prevent all types of torture as part of using Elephants at festivals. The Wildlife Protection Act 1972 specifically states that Elephant should not be used to pull or to push or to bear anything having a weight of more than thousand Kilograms. The lower part of the Ayalur radham have a weight of more than 5 tones. With all the decorations above the base of the chariot, it may weigh more than 10 tones. Both the police, the revenue and forest officials remain as mute spectators on this type of abusing Elephant as part of ratholsavam. Eventhough, the Kerala State had banned parading of more than 3 Elephants inside the compound wall of any festival places, the Ayalur festival committee also used five Elephants under scorching sunlight after the completion of ratholsava. Supreme Court had clearly stated that the monitoring committee for the prevention of cruelty to Elephants which is chaired by the District Collector must ensure that Elephants are not subjected to any type of cruelties as part of temple festivals. The Ayalur festival committee had not even applied to the office of the District Collector seeking NOC for the use of Elephants as part of Thiruvathira festival. We expect that your authoritative office issue strict orders to your subordinate offices to arrest all the persons who were parties to this type of torture of Elephant.
