Assistance in this matter of Malfeasance in office and official Misconduct.

The purpose of this Petition, is to further give support to my request that I made to the New Jersey State Police, Colonel Joseph R. Fuentes on May 17, 2014, by mail (#:9114901159815767853826), to execute a citizen arrest without a warrant against the Somerset County Sheriff, Frank Provenzano and those Sheriff’s officers who were present and executed the wrongful forced eviction on me, my family and tenant on August 8, 2011, at 51 Hillcrest Blvd, Warren, NJ.   

Due to the fact that the police Warren Twp., and the Somerset county Prosecutor are refusing to act on my case, therefore, I had no other choice to request assistance from the New Jersey State Police in this matter of Malfeasance in office and official Misconduct.

Malfeasance has been defined by appellate courts in other jurisdictions as a wrongful act which the actor has no legal right to do; as any wrongful conduct which affects, interrupts or interferes with the performance of official duty; as an act for which there is no authority or warrant of law; as an act which a person ought not to do; as an act which is wholly wrongful and unlawful; as that which an officer has no authority to do and is positively wrong or unlawful; and as the unjust performance of some act which the party performing it has no right, or has contracted not, to do.

In this matter, the County Sheriff, Frank Provenzano wrongful forced eviction on me, my family and tenant on August 8, 2011, is an affirmative act of felony.

The Provenzano's act of felony has been done in an official capacity of a Sheriff, under the color of office.

This Provenzano’s act of felony has interfered with the performance of official of the court duties and therefore fraud upon the courts was committed.

The laws of our land are clear!

 "No man in this country is so high that he is above the law. No officer of the law may set that law at defiance with impunity. All the officers of the government, from the highest to the lowest, are creatures of the law and are bound to obey it. It is the only supreme power in our system of government, and every man who by accepting office participates in its functions is only the more strongly bound to submit to that supremacy, and to observe the limitations which it imposes upon the exercise of the authority which it gives.”

 

Truax v. Corrigan, 257 U.S. 312, 332 "Our whole system of law is predicated on the general fundamental principle of equality of application for the law. 'All men are equal before the law,' "This is a government of laws and not of men,' 'No man is above the law,' are all maxims showing the spirit in which legislatures, executives, and courts are expected to make, execute and apply laws. But the framers and adopters of the (Fourteenth) Amendment were not content to depend... upon the spirit of equality which might not be insisted on by local public opinion. They therefore embodied that spirit in a specific guaranty."

 

As per the above said, this is a criminal case and Sheriff Frank J. Provenzano is not above the Law!

             The evidence that I have provided in the video and to New Jersey State Police office on May 17, 2014, by mail (#:9114901159815767853826) , apart they proves the violations of the NJ Statutes - Title 2C The New Jersey Code of Criminal Justice - 2C:30-2 Official misconduct, also further proves criminal actions arising under the Constitution;  U.S.C. 42 §1983; a civil action for deprivation of rights; U.S.C. 42 §1985; a civil action for Conspiracy to interfere with civil rights, such as an act to deceive, an act of fraud, an act to manipulate due process and Title 18 U.S.C. § 1505.

 "There is no crueler tyranny than that which is exercised under cover of law, and with the colors of justice ..." - U.S. v. Jannotti, 673 F.2d 578, 614 (3d Cir. 1982)

 It is not a job for a single citizen to fight corruption; however, it is our duty as American to report illegal activities and to have our Courts, (We the people as Jurists) to handle criminal cases, such this case. Justice need to prevail in all cases!

Therefore, with this petition I’m requesting from the New Jersey State Police, Colonel Joseph R. Fuentes, to execute my request of citizen arrest without a warrant against the Somerset County Sheriff, Frank Provenzano and those Sheriff’s officers who were present and executed the willful wrongful forced eviction on me, my family and tenant on August 8, 2011, and the prisoners must be taken without unnecessary delay before the nearest available judge, Grand Jury or other appropriate government official.
