Start a class action lawsuit against Fitness Depot for anyone who was affected by breach

The Issue

On June 3rd, 2020, Fitness Depot emailed all of their customers letting them know of a security breach which occured on their website, which prompted the release of sensitive information such as credit/debit card numbers, name, home address, email address and telephone numbers to cyber criminals. Many people were affected by this as their card information had been compromised and were charged for multiple transactions they did not make ranging from a few hundred to thousands of dollars.

In the companies statement, they blamed the breach on their internet service provider stating "based on our preliminary findings it appears our Internet Service Provider [ISP] neglected to activate the anti-virus software on our account". However, InternetServiceProviders are NOT responsible for any anti-virus protection, that is on the company and their web developers.

The company also stated that "It appears the cyber criminals were able to place a form on our Fitness Depot website that was misleading". This was a form placed on their site for 1-3 months that neither their web developers, IT workers or any other higher up monitoring the security of their website, could catch.

It's clear that Fitness Depot does not value their customers sensitive information or online security. A company that disregards the security needs of their consumers until after a breach has occured and many consumer's credentials taken, speaks volumes about the integrity of Fitness Depot. Typically after  a company is subject to a data breach they offer a credit monitoring service, but Fitness Depot has made no such effort. Which such a rapid increase in sales and profit of fitness items during this time, it is expected that companies like this also increase their cyber security.

This company sent out a mass email apologizing to consumers after their credentials had been stolen and left it at that. This is bigger than an email apology, this is a legal matter.

Please sign this petition to garner enough signatures to start a class action lawsuit against Fitness Depot. With over 20+ locations in Canada and 2 in Texas, this is absolutely unacceptable. We need atleast 12 to start a class action lawsuit. We will not take this lying down.
