We, the undersigned, stand with Hoopes Vineyard and the Oasis Animal Sanctuary in their ongoing battle to preserve their rights, legacy, and important contributions to the Napa Valley community. Hoopes Vineyard has been operating for over 40 years, providing Napa Valley residents and visitors alike with a unique and cherished experience.
The winery operates lawfully under state and federal regulations and continues to enrich our community. In addition, the Oasis Animal Sanctuary provides a safe haven for rescued farm animals and regenerative farming.
Despite these vital contributions, Hoopes Vineyard and the Oasis Animal Sanctuary are facing unjust enforcement actions from Napa County, threatening the livelihood of this family-owned business and their ability to continue these meaningful operations.
We urge Napa County officials to support Hoopes Vineyards and the Oasis Animal Sanctuary by allowing them to continue their lawful operations and the pre-existing rights afforded to them. We further urge Napa County Officials to create legislation/take measures to protect these historic, lawfully conforming wineries. Their contributions to our community are invaluable, and their rights must be upheld.
For Context:
Friends, as you are no doubt aware, we have been the subject of Napa County’s ire for the past few years which required us to defend our business in a very expensive state court lawsuit. Napa County believes it gets to decide which wineries are worthy and those it deems unworthy it has decided to put out of business. We are the most recent winery they have deemed unworthy because we have chicken coops, farm animals and want to provide our customers with a unique experience at our “Oasis.” It is a frustrating turn of events given that the county does not dispute that we are a lawfully licensed winery with the right to unlimited customers. They just don’t want us to “market or advertise wine through use of animals” or “provide samples for the unlimited customers they agree are allowed on the property.” Now we are facing a request from the County for $8 million in penalties. If that was not bad enough, the County is also asking the court to enter an injunction which would effectively eliminate all private wine tasting in Napa County and redefine any consumption of wine at a winery to be a public tasting which is only allowed at around fifty of the five hundred or so wineries in the county.
To all small wineries in Napa, be aware that this injunction will change how you have to operate and may require you to stop all on-site sales of wine for consumption.
But don’t worry, we have not given up. Hoopes has joined our friends from Smith-Madrone Vineyards and Summit Lake Vineyards to bring a lawsuit in federal court in San Francisco to protect our rights. To help us in our federal fight, please sign our petition. Together we can send a message to the county that they do not get to decide which wineries are worthy. We need to support small businesses in Napa (before we are all gone). As the federal court in our case recently noted, “This case involves serious constitutional and statutory questions."
