A global problem:
The Forceful reforming of complex medical malpractice without clinical insight, so that it fits common law standards and judgements will only benefit every person charging for their services. The longer it takes the higher the charges.
This will exponentially increase healthcare costs for all, encourage ultra-defensive medical practice across the board and decrease the number of doctors willing to perform their profession beyond their risk, benefit or calling.

(Get the questions answered first, listen to science, treat the grief, simplify the medicine, gain insight to accept or decline the outcome)
-Specialised clinically efficient courts.
(Start with the science, end with the Law)
-Clinically trained personnel interpreting the evidence. (Did the doctor follow the science?)
-Legally trained personnel interpreting the law.
(What are the consequences if there was no science followed?)
-The captain of the ship principle.
Stop scapegoating.
(Was the doctor alone responsible for “sinking the ship”?)

In what some call a "disturbing trend," efforts are being made to broaden the definition of "family members" who can sue physicians for wrongful death. In addition, the types of emotional damage that physicians can be sued for is expanding in pockets across the nation. The latest effort to expand the capacity to sue, a bill in New York state, failed when it was not signed by the governor ― but a toned-down bill is in the works.
