We, the undersigned residents, business owners, and stakeholders of Little Falls, Amorosa, and surrounding areas, hereby petition the City of Johannesburg and the Gauteng Liquor Board to take immediate, decisive regulatory action against Tiger’s Milk Kwena Square. We demand the suspension or total revocation of their business trading licence and liquor licence due to persistent, severe noise nuisance and ongoing illegal land use spanning a period of three (3) years.
THE GROUNDS FOR THIS PETITION:
Illegal Land Use and Zoning Violations: Tiger’s Milk Kwena Square is actively operating as a "Place of Amusement" (hosting DJs, live loud music entertainment, and nightlife events) without the necessary zoning rights, special consent, or land-use approvals from the City of Johannesburg. This constitutes a direct violation of the City of Johannesburg Land Use Scheme (2018).
Breach of Environmental Law: The ongoing, high-volume noise emissions from these unauthorized entertainment activities directly violate Regulation 8 of the Gauteng Noise Control Regulations (1999), which prohibits any person from causing a noise nuisance.
Violation of Public Health By-Laws: The establishment operates in continuous breach of the City of Johannesburg Public Health By-laws, specifically regarding the generation of psychological and physical distress to nearby residents through uncontrolled ambient noise pollution during late-night hours.
Failure to Adhere to Liquor Licence Conditions: Under South African liquor legislation, a licensed establishment must not operate to the detriment, nuisance, or disturbance of the surrounding peaceable inhabitants. Tiger's Milk has consistently failed to self-regulate or confine its activities to its permitted restaurant usage.
Impact on Well-being and Property Values: For three years, residents—including young children, working professionals, and the elderly—have suffered from chronic sleep deprivation and diminished quality of life due to an illegal nightclub-style operation masquerading as a standard restaurant.
OUR DEMANDS:
Therefore, the community requests that the targeted authorities take the following steps in parallel with ongoing Environmental Health investigations:
The City of Johannesburg Development Planning Department (Zoning Enforcement) must immediately issue a Cease-and-Desist/Contravention Notice to Tiger's Milk for operating an unauthorized Place of Amusement.
The Section 79 Petitions Committee must urgently table this matter, investigate the failure of law enforcement to curb this 3-year nuisance, and instruct the Johannesburg Metro Police Department (JMPD) to enforce local municipal by-laws.
The Gauteng Liquor Board must conduct an emergency compliance hearing regarding the liquor licence held by Tiger’s Milk Kwena Square, with a view to suspending the licence due to the misrepresentation of their permitted business activities.
The Landlord / Center Management must enforce the tenant lease terms regarding public disturbance and cease allowing activities that breach local zoning laws.
We state that all routine reporting channels have been exhausted over a 3-year period without permanent resolution, forcing the community to seek formal intervention through this collective petition.
