Legal Update:
The Supreme Court of the United States sides with Mr. Abrego Garcia who was "mistakenly" deported to the CECOT prison in El Salvador. In effect, the Court remanded the case back to the lower court with directions that the US Government must follow the order to facilitate and effectuate his return to the United States.
Justice Sotomayor in her Statement, joined by Justices Kagen and Jackson states: "To this day, the Government has cited no basis in law for Abrego Garcia's warrantless arrest, his removal to El Salvador, or his confinement in a Salvadoran prison. Nor could it."
She goes on to say that, "The Government must comply with its obligation to provide Abrego Garcia with 'due process of law,' including notice and opportunity to be hear, in any future proceedings. Reno v. Flores, 507 U.S. 292, 306 (1993). It must also comply with its obligations under the Convention Against Torture. See Convention Against Torture and Other Cruel and Inhuman or Degrading Treatment or Punishment, Dec. 10, 1984, S. Treaty Doc. No. 100-20, 1465 U.N.T.S. 113.
