Arrest Mr. Kochouseph Chittilappilly & Jose Maveli for inciting people to kill stray dogs
The Issue
For the last couple of years there have been multiple incidents of killing stray dogs mercilessly in different districts and places of Kerala. The incident is in rise and local people who are not authorized to control the stray dog population are involved in the countless killing without any scientific assessment of individual cases. This is not only very unfortunate but also a matter of shame for the entire nation which is known for love, respect, national integrity and its culture of peaceful co-existence with animals, that Mr. Kochouseph Chittilappilly who claims himself as a humanist, is inviting, encouraging and instigating local people through social media like Facebook to mercilessly kill street dogs and giving away cash and cheque rewards to the killers and keep on promising people of reward and provide with all the legal helps in case of arrest.
No Indian citizen is allowed to take the law in his/her hands and must respect the Indian Constitution and abide by the Indian Laws irrespective of their social positions and everybody should and must obey the Supreme Court order.
Below are the Indian Laws that have already been disrespected and violated by Mr. Kochouseph Chittilappilly and Jose Maveli to such an extent that it should no way be ignored and they must be stopped with some strong legal actions on them.
1. Section 11(1) (I) of PCA Act, 1960 – Killing stray dog is a cognizable offense. – This enables police to arrest anyone without any warrant and police can file FIR directly on the culprits
2. Sec 11(1)(a) to (o) of PCA Act,1960 – All sorts of animal cruelty and mistreatments of dogs including culling of dogs which are already sterilized are mix of cognizable and non-cognizable offense.
3. Act 34 of 2007 – The Kerala Anti-Social Activities (Prevention) Act, 2007 (KAAPA) – serial offender regarding animals and misusing child labor
4. It is the fundamental duty of every citizen of India to have compassion for all living creatures. Article 51A(g)
5. To kill or maim any animal, including stray animals, is a punishable offence. IPC Sections 428 and 429.
6. Stray dogs that have been operated for birth control cannot be captured or relocated by anybody including any authority. ABC Rules, 2001
7. Information Technology Act, 200 – Using social media to spread hatred and defaming Govt. officials and encouraging people to disrespect supreme court order
8. Section 34, IPC (Common Intent) - Many people operating on the same agenda i.e., In this case killing stray dogs.
9. Section 107, IPC - Abetment of crime
10. Section 503/506, IPC (Criminal Intimidation) - Threatening animal welfare groups and animal loving people as well as Govt. officials.
As per the PCA Act, 1960 (Chapter 59), stray dogs on Indian soil deserve to be treated with love and compassion.
Solution: Administration is expected to take strong action against the people who insults Indian Constitution in an open forum and creates a dirty and terrifying image of country to the international world.
Administration should involve the expert Animal Welfare Organizations to ensure proper implementation of ABC (Animal Birth Control). Administration should not allow people to take the law in their hands and kill any animal whenever and wherever they wish to.
Mr. Kochouseph Chittilapilly and Jose Maveli should be booked and arrested immediately to on the basis of cognizable offenses in multiple occasions to stop spreading of hatred towards street animals anymore by them
This is our appeal to you all to take an immediate action to arrest Kochouseph Chittilappilly and Jose Maveli for instigating, promoting killing and for demonstrating inhumane behavior and criminal action towards the voiceless defenseless innocent dogs.
