Set a Fair Bond for a Father Charged with Murder in a Case Involving His Child

The Issue

We, the undersigned, respectfully ask the Court in Roane County, Tennessee, to set a fair and obtainable bond for Zackary Lowe, who is currently incarcerated and charged with first degree murder following an incident in which he acted to defend and protect his child from a known violent felon that had been repeatedly released into our communities. Zackary had previously sought help from law enforcement on multiple occasions prior to the incident.   This case is not simply about a charge on paper. It is about a father, his children, and the circumstances that led to a moment driven by fear, protection, and the instinct to keep his family safe.   Zackary Lowe is not a danger to the community and does not present a risk that would justify continued detention without a reasonable opportunity for release:   He has no prior criminal charges or history.
He is not a flight risk and has deep ties to his family and community.
He turned himself in almost immediately, prior to any discovery of a crime and without attempting to evade responsibility.
He is a present and needed father whose children are currently living without his daily care, support, and protection.    The purpose of bond is not punishment before trial. It is to reasonably ensure a defendant’s appearance in court while preserving the fundamental principle that a person is presumed innocent unless and until proven guilty.   Keeping Zackary Lowe incarcerated without a fair and attainable bond causes unnecessary harm to his children and family while offering no meaningful benefit to public safety.   For these reasons, we respectfully urge the Court to:   Set a fair, reasonable, and obtainable bond that allows Zackary Lowe to return home to his children while awaiting the resolution of this case.   Justice requires balance, compassion, and fairness.
