The Issue
For at least 34 years, landlords and tenants in Newfoundland and Labrador have been left without the protection of an enforceable Residential Tenancies Act. While the law was passed decades ago, the government has consistently failed to fulfill its responsibility to enforce its provisions, instead telling the public to handle certain disputes themselves—on their own time and at their own cost. This failure has created an environment where some individuals repeatedly violate tenancy laws without facing any meaningful consequences, emboldened by the lack of oversight and accountability.
One year ago, the government finally acknowledged this gap in enforcement and committed to addressing it. Yet, despite this promise, there has been no meaningful progress. Landlords and tenants continue to face housing instability, a lack of legal recourse, and uncertainty about when the government will act.
The new minister of Digital Government and Service NL, appointed in July, has offered no clear timelines or public updates, only vague assurances that action is “coming.” This delay perpetuates the hardship experienced by individuals who depend on a fair and functioning rental system.
The lack of enforcement has created a system where some individuals blatantly ignore the Residential Tenancies Act, knowing there are no consequences for their actions. Without a deterrent in place, landlords and tenants alike are left vulnerable to those who exploit the law for personal gain. This failure to uphold the law not only undermines trust in the system but also perpetuates housing instability and unfair practices across Newfoundland and Labrador. It is time for the government to step up and ensure accountability by enforcing the laws already in place.
We call on the Government of Newfoundland and Labrador to:
- Deliver on its commitment to enforce the Residential Tenancies Act without further delay.
- Provide clear timelines and regular updates to the public on the progress of implementing enforcement mechanisms.
- Ensure a fair and accessible system for landlords and tenants to resolve disputes effectively and without undue burden.
The people of Newfoundland and Labrador deserve better. We demand meaningful action now to ensure housing stability, fairness, and justice for all.
