

The Disability Rights Section, Civil Rights Division, U.S. Department of Justice has referred our complaint CTS# 646255 filed on October 24, 2018 regarding California State Parks, Calabasas CA against Angeles District Parks to the US Department of the Interior, Office of Civil Rights for Appropriate Action. They also stated that if the Agency has any questions or concerns about this referral or believes that it raises issues outside the agency's jurisdiction for me to contact the Department of Justice again. I am not sure I am entirely comfortable with them passing the buck but let's see how this goes. I do question if the Department of the Interior has jurisdiction. That is the same Department that National Park Service operates under and we already know their position on low power pedal assist e-bikes. They are prohibited. They consider them motor vehicles. They also do not recognize them as acceptable OPDMDs on Federal land because they would have to be built specifically for the disabled and for indoor use. But this is State land in questions (State Parks) so maybe they get that per the DOJ 2011 rule allowing them.
