Be advised that you are in violation of ADA and the 2011 DOJ rule.
Departmental Notice 2011-02 issued on March 17, 2011 requiring OPDMDs to be less than 48' in length requiring an application for a deviation and then denying it for reasons other than legitimate safety reasons is clearly a violation of the DOJ order.
You state in a Jan. 17.2018 e-mail to Mr. Lovit declining his request for access with his OPDMD " The reason the Department is not allowing the use of e-bikes as an OPDMD in the Angeles District is due to the fact that allowing them poses a conflict with Federal land management laws and regulations that currently ban the use of e-bikes in this region. "
The DOJ rule clearly states that "People with disabilities have the right to choose whatever mobility device best suits their needs." It also states " In addition, covered entities must allow people with disabilities who use any OPDMD to enter the premises unless a particular type of device cannot be accommodated because of legitimate safety requirements. Such safety requirements must be based on actual risks"
Further Federal land management laws do not apply to the Angeles District State Parks trails in question the as this is not Federal land. To the contrary State law AB1096 applies which grant access to low power pedal assist class one and two E-bike's to state parks. Superintendent Craig Sap's order banning all e-bikes can not superseded the ADA 2011 DOJ rule.
I respectfully ask that you reconsider Mr. Lovit's request and allow class one and two low power assist e-bikes in Angeles district parks as OPDMDs.
Further attached is a copy of a letter signed by over 3000 supporters along with their reasons for supporting the rescission of Superintendent Craig Sap's order banning e-bikes in Angeles District Parks. NPS can't be dictating state park policy where state law and ADA DOJ rules clearly cover the State park jurisdiction not Federal land management rule effecting adjacent land in the region.
Lastly if Mr. Lovit is not granted access for his OPDMD within 10 days, we will file a complaint with the Department of Justice on his behalf and on behalf of our now 3100 petition supporters and 600 members.
As of now Superintendent Craig Sap is pointing to the State and the State is pointing to Superintendent Craig Sap for the policy. OC Parks clearly took a position on this and are allowing class one and two low power assist e-bikes as OPDMDs. Angeles Parks can do the same. It is not Angeles District Parks responsibility to enforce federal land management rules on adjacent NPS property.
Lastly it was said that Superintendent Craig Sap's order banning e-bikes was temporary pending state wide rules. Please forward this request along with the 3000 signatures and reasons for signing who will be making those rules and provide me with their name and contact information.

Again to be clear if Mr. Lovit's request for OPDMD deviation is not approved within 10 days of this E-mail we will file a complaint with the DOJ and you can deal with them and explain why Angeles District Parks is violating their access rules for other than legitimate safety reasons.
