On Thursday, June 13, 2013 at approximately 9:00 PM EST, Timothy Alan Hill, age 41, who resides in a suburb of Lexington, Kentucky, was arrested for protecting his Family and Property. This Petition is to have ALL CHARGES against Timothy Alan Hill dropped and demand his immediate release from the Lexington Fayette Urban County Detention Center, Lexington, Kentucky. Mr. Hill is a wonderful family man, who works Full-time and enjoys spending his free time with his loving Wife Kate, their beautiful family, volunteering for non-profit organizations, woodworking, playing pool and teaching. Mr. Hill is an upstanding citizen with no history of violence nor has he ever been in trouble with the law.
When Timothy Hill arrived home late Thursday after a hard day’s work he was confronted with a situation of approximately 30 individuals gathering in the cul-de-sac where his home is located. He could hear the individuals yelling different things about a possible fight that was going to take place. He decided to advise them to disperse or he would be calling the Lexington Police Department. Tim Hill remained on his property while Abdul Simmons, a known Felon and approximately 6 other grown men came onto his property. Just 6 months ago in December 2012 Abdul Simmons was charged with stealing a car, leading Lexington Police on a high speed chase, crashing the stolen car, fleeing on foot, possession of drugs, and no driver’s license. Mr. Hill advised Abdul Simmons and the other men with him to get off of his property and at that point in time Abdul Simmons (age 18) pulled off his shirt and charged after Mr. Hill in a very threatening and aggressive manner. The other 6 men were behind Abdul Simmons also charging towards him. Mr. Hill who was on his own property in the driveway was standing next to his car, he opened the car door reached into his car and grabbed his hand gun and brandished the weapon in an attempt to deter his attackers. Mr. Hill has his Carrying Concealed Weapons Certificate and prior Military experience from the United States Army. Mr. Hill never pointed the gun at anyone, which is what Abdul Simmons has claimed. Mr. Hill immediately called 911 from his cell phone and requested emergency assistance from the Lexington Police Department.
The Lexington Police arrived and took statements from approximately 30 individuals who were a part of the cul-de-sac disturbance. However, Abdul Simmons did not supply the police with a statement initially as he and his 6 friends took off and were gone when the police arrived. If Abdul Simmons and his 6 friends had done nothing wrong why did they feel the need to leave before the police arrived? The Lexington Police Department and namely Officer Steele never obtained a statement from Mr. Hill, his family, or any of his neighbors who actually witnessed Mr. Hill protecting himself and his family on his own property. Officer Steele ordered these witnesses back into their residences, with the threat of incarceration.
Timothy Hill was handcuffed, arrested by Officer Steele with a charge of Felony Wanton Endangerment 1st Degree- One Count, and lodged at the Lexington Fayette Urban County Detention Center. Mr. Hill appeared in Court before a Lexington Fayette County Judge on Friday June, 14, 2013 where he pled NOT GUILTY, and gave a statement. "I, in no way, meant them any harm. The only thing I was doing was protecting myself because I felt threatened.” The Judge ordered a $5,000.00 cash bond.
Friday night Mr. Hill’s family posted his bond and as he was being processed for release from jail, arresting Officer Steele arrived at the Lexington Fayette Urban County Detention Center. He placed an additional 15 counts of Felony Wanton Endangerment 1st Degree against Mr. Hill in order to keep him incarcerated with a new cash bond amount of $75,000.00. The detention center rebooked Mr. Hill on the additional charges that were filed.
This story has been presented many times since Thursday on the News in Lexington, Kentucky who has given very one sided views, and failed to investigate any further. They show individuals who state they are traumatized, but also fail to mention their involvement in the violence that occurred in Mr. Hill’s cul-de-sac which in sighted this situation.
Mr. Hill should not be incarcerated but applauded for his bravery in protecting his Family.
This is still The United States of America we live in, correct? Our 2nd Amendment Rights afford us the right to bear arms. The Declaration of Independence gives us the right to protect life, liberty, property, and the pursuit of happiness.
Since when is it ever okay for a known felon to come onto your property, threaten and charge at you in a violent manner!!! There was more than just one man threatening him, there were several. These were not teens like the news has led it’s viewers to believe. These are grown men, with very long records, who are known criminals!!! These men are FELONS, Drug users, thieves, nuisances to society, don't blink an eye or they will rob your home!!! So why are they being portrayed as the "victims" here?
Timothy Hill is the real "victim" here. He states he felt threatened and was in grave fear for his family’s safety. Mr. Hill is still currently incarcerated. If He is found guilty he could be sentenced to 30 years in prison.
We are supposed to be protected from abuse by government entities. The Commonwealth of Kentucky has not only failed to protect Mr. Hill’s Inalienable Rights as a United States Citizen, they have trampled on his Amendment Rights afforded to Him by The United States of America. Our fore-Fathers would roll over in their graves.
I sincerely hope you are never confronted with the situation where you have to risk your life to protect the lives of your family members and yourself. If it does occur I hope you’re never arrested, incarcerated, and facing 30 years in prison.
