The Issue

This is a Petition to Protect Children & Families from Unethical Judicial Misconduct AND for the Removal of Judge Jennifer Harlacher Sibum from the Bench of Monroe County Court of Common Pleas, Stroudsburg, Pennsylvania

My name is Kai Rivera, and I am 21 years old. I’m reaching out to the public to help protect my two little brothers, E and Z, and seek justice for the devastating impact of judicial misconduct and corruption in our family’s case, after I disclosed abuse as well as my brothers by our abuser, who is my stepfather, a Guidance Counselor for the East Stroudsburg Area School District. An unethical judge, presiding in the Monroe County Court of Common Pleas, judge Jennifer Harlacher Sibum has close personal ties to my abuser and his attorney and collectively, perpetuated a cycle of injustice, allowing bias, corruption, and collusion to tear our family apart. As a result, my brothers and I have been systematically alienated from each other for over 20 months, and the emotional toll of being denied any contact with each other has destroyed our once-loving family and brother bond. Ever since our mother pursued a divorce and left our abuser in 2022, he ran a public smear campaign against her as he increased his abuse tactics against all of us, which there is plenty evidence of but due to his powerful connections, justice was delayed then completely altered to cover up abuse and protect him, the abuser over the victims. My brothers are held captive with the abuser and have no contact with their Rivera family they have known their entire lives.

This situation represents a profound violation of our Constitution's Equal Protection Clause and Due Process rights, including our right to family integrity under the 14th Amendment. The lasting trauma caused by the forced separation of siblings and the denial of contact is not just a personal tragedy—it is a public issue. This case is part of a larger family court crisis that plagues Pennsylvania and the United States. In Pennsylvania alone, over 20% of children involved in family court proceedings experience severe emotional harm due to biased rulings and the failure of the system to address abuse. The National Family Court Watch Project reports that 70% of parents feel family courts routinely fail to protect children from abuse, with many judges ignoring clear evidence of harm due to personal relationships or political bias.

This petition sum-ups the numerous violations and crimes committed by Judge Sibum that calls for immediate action to further expose the corruption in Monroe County, Stroudsburg, PA as it has impacted other children as well such as, A.H. and C.T.H. who was unlawfully kidnapped as Judge Sibum knowingly conspired to facilitate or cover up the kidnapping as she unlawfully incarcerated a domestic violence victim without due process, that she also granted protection orders for.

Judge Sibum has engaged in repeated violations of judicial conduct, undermining both the public trust and the rights of vulnerable individuals and families. Her actions demonstrate breaches of her oath of office, conflicts of interest, personal bias, and unethical behaviors and decision-making, particularly in child custody cases, where she has ignored evidence and acted contrary to legal standards. These violations align with provisions under Article V, Section 18 of the Pennsylvania Constitution, which allows for the removal or discipline of judges for incapacity or misconduct. Her actions have also breached both the U.S. and Pennsylvania constitutions, particularly Article VI, Clause 3 of the U.S. Constitution and Pa. Const. Art. V, § 10, which require judges to uphold the law impartially and impart justice in an unbiased manner. Moreover, Judge Sibum's decisions in domestic violence cases have denied due process and violated the protections afforded to victims under federal and state law, including the Violence Against Women Act and the Protection from Abuse Act and Kayden’s Law.

In addition to ethical and constitutional violations, Judge Sibum has demonstrated a pattern of judicial misconduct, including favoritism, corruption, and selective application of the law. Her personal relationships with certain individuals have influenced her rulings, violating the Pennsylvania Rules of Judicial Conduct, particularly Rules 2.3 and 2.11, which prohibit bias, prejudice, and conflicts of interest. She has also made unlawful rulings that prioritize personal connections over the best interests of children and parents, including improper custody decisions that place children in harmful environments. Furthermore, her actions have led to the deprivation of rights for parents, siblings like me and A.H., and our grandparents and particularly marginalized communities, including women of color and low-income individuals, like my mother, violating principles established in cases such as Troxel v. Granville and Bearden v. Georgia. Additionally, Judge Sibum's involvement in the illegal relocation and possible trafficking of children, as well as her failure to uphold the law in cases involving domestic violence, further substantiate the claims of misconduct.

This petition aims to inform the public about the serious violations committed by Judge Sibum involved in my family’s case, Reichl vs. Rivera, and calls for action to hold her accountable to ensure that justice is served in Monroe County and restore fairness to the families impacted by her cruelty. Under Article V, Section 18 of the Pennsylvania Constitution, a judge may be removed from office for behavior that constitutes incapacity, misconduct, or a failure to perform the duties of the office. Given the gravity of her actions, it has been requested that appropriate authorities conduct an impartial investigation and take necessary disciplinary actions, including the removal of Judge Sibum from the bench, to restore public confidence and uphold judicial integrity.

Together, we can demand a system that prioritizes the well-being of children, upholds constitutional protections, and ensures that no family is torn apart by corruption, collusion, and the concealment of abuse as my family has been experiencing for more than three years now. I filed a police report with Pennsylvania State Police in August 2022 about the abuse by my stepfather, and at a minimum should have charged my abuser with Aggravated Indecent Assault (18 Pa.C.S. § 3125). I have since publicly disclosed and appeared on a podcast, “Slam the Gavel” and a YouTube channel “Mother with a Voice” where I share my story about the abuse and continue to do so on social media platforms where I’m making attempts to also contact my little brothers, everyone please follow me to learn more:

Therefore, WE, demand the REMOVAL of Judge Jennifer Harlacher Sibum from the bench of the Monroe County Court of Common Pleas of Stroudsburg, PA, due to her repeated and severe violations of her judicial duties. Judge Sibum has violated the standards of conduct expected of judges in Pennsylvania and has demonstrated behavior that undermines public confidence in the judicial system and should not be protected by “absolute or qualified immunity”.
