

SUBMISSION TO HUMAN RIGHTS COMMITTEE
WORKING GROUP ON DISCRIMINATION AGAINST WOMEN AND GIRLS
CEDAWinLAW is delighted to announce the above submission on behalf of ALL #50sWomen with a request to the Human Rights Committee, Working Group on Discrimination Against Women & Girls, to take up matters now at an impasse.
The standstill itself has been created, chiefly but not exclusively, by lawmakers who apparently ignore enforceable laws onside ALL 50sWomen and others who seemingly kept vital information from the majority of 3.5m victims, for years.
The submission complements our request to the CEDAW Committee, Geneva, for an Inquiry under Art. 8 of the Optional Protocol on behalf of ALL 50sWomen.
The UK State Party's Obligations under the ratified CEDAW Treaty were examined by CEDAW People's Tribunal 2021 and The President's Report found adherence to the International Law's Articles & Recommendations to be wanting in several areas.
This year, the ratified CEDAW Treaty, General Recommendation 40, was adopted. The ground-breaking General Recommendation 40 enables women to lead at decision making tables under this International Law.
The impact of the state pension age changes on ALL #50sWomen was examined in CEDAWinLAW's People's Tribunal 2022 and The President's Report and led to a legal challenge being mounted, which was paused whilst developments took place.
Both Ms Rebecca Hilsenrath, PHSO, and her predecessor, Sir Robert Behrens, are aware the legal rights enshrined in both the above Reports [lauded by Andrew Gwynne MP at Dr Scutt's presentation to the APPG (State Pensions)] yet these legal rights were not highlighted in the PHSO's Report.

CEDAWinLAW advised earlier the postponement of its action against the Secretary of State for Work & Pensions. *Whilst its case is clear that the Secretary of State refused unlawfully reasonable invitations to mediate*, it has decided to wait upon further developments before proceeding with its judicial review, which it withdrew. Funds generously donated were used in launching the judicial review and taking advice. Those funds fell short in the timing of providing funds for a full-blown fight in front of the court. Our counsel, John Cooper KC, said of the fight;

CEDAWinLAW notes:-
(a) the favourable new historic Civil Procedure Rules on Alternative Dispute Resolution (Mediation);
(b) the Attorney General's welcome new guidance on the Rule of Law to government lawyers;
(c) the absence of the high principles of the Prime Minister's 'Civil Society Covenant' regarding matters in hand;
(d) the comment by the President of the UK Supreme Court, The Lady Hale "The fundamental principles of equal treatment cannot depend upon how much money happens to be in the public coffers at any one time ... that argument would not avail a private employer and should not avail the State."
CEDAWinLAW calls for the Waspi Board members to stand down following the Secretary of State for Work & Pension's refusal to award compensation for Maladministration out of the PHSO Report.
For Waspi groups' members - many of whom who already support several groups - to instead support CEDAWinLAW's call for Mediation to settle a financial remedy on behalf of ALL #50sWomen - not a few.
A neutral team of expert mediators is on standby to be considered for the role.
