A Brief Summary of the points addressed by Hon Dr Jocelynne Scutt AO follows:
- The Judicial Review into the cuts to Winter Fuel Payment, which impact harshly on 50sWomen who are already suffering due to the clawback of their pensions
- The "unworkable & unwise" nature of suggestions for implementation of the Parliamentary Ombudsman’s report and the difficulties for BOTH 50sWomen and the DWP in implementing his recommendation in any targeted way, adding to administration costs and putting the burden of proof of negative impact on the women (rather than the DWP who were responsible for the problem)
- CEDAW General recommendation 40 that puts an indisputable obligation on Govts to involve women equally at every level of decision making in Government about laws and measures that affect them, including resolving the 1950s pensions issue with fairness and justice
- CEDAW Optional Protocol Article 8: CEDAWinLAW have taken the unresolved issues of the failure of Government to agree to mediation and both direct & indirect discrimination and maladministration to the CEDAW Committee
- The written response from the Secretary of State for Work and Pensions to CEDAWinLAW’s request for mediation is “unfathomable, extraordinary, not consistent with the Law” (see more details below)
- How a Temporary Special Measure can legally be used to implement full restitution
- The role of the Women's Parliament on 9 Dec in ensuring women's voices are heard, on a motion about the urgent need for Government to abide by and implement the Beijing Platform & Declaration, which was signed by the UK Government in 1995

Dr Jocelynne Scutt leads the charge at the APPG
Until this month the only organisation allowed to approach the group were WASPI and their lobbyists Higginson Strategy.
The two main speakers were Joanne Welch, who organises CEDAWinLAW and Jocelynne Scutt, the former Australian judge, author of a report on the discriminatory nature of the treatment of the 3.6 million women and chair of the people’s tribunal, that examined the issue.
Their arguments will be familiar to my readers – seeking mediation with the government to decide the level of compensation rather than accepting the guidelines by the former Parliamentary Ombudsman, Robert Behrens, for limited compensation for partial maladministration.

Historic new Civil Procedure Rules on Alternative Dispute Resolution
• The Minister acknowledges that the Ministry of Justice confirms that Mediation can take place without the institution of any legal action
• The Minister stated upon her appointment an intention to meet with all groups
• The Minister met with another group with no legal action on foot and publicised that fact
• The Minister said she will not meet with CEDAWinLAW with no legal action on foot
CEDAWinLAW declares the Minister's written response as unworkable and claims entitlement under the precedent set to such a meeting afforded to another group, in due haste.
CEDAWinLAW provides a Paper entitled 'Mr Hunt and the Law' to address the Minister's point on backto60's earlier judicial review.
