Say NO to the Preserve-Marvin Creek Connector Trail!

The Issue

My home, along with many others in Marvin Creek, is directly impacted by the proposed Preserve-Marvin Creek Connector trail. We fear that this development will expose our neighborhood to unnecessary risk and liability, exacerbate flooding, compromise our privacy and security, introduce increased crime risk, pose a threat to human safety, and disturb the wetlands and wildlife (including endangered species). 

Moreover, our HOA Board did not notify Marvin Creek homeowners of the easement they wished to grant to the Village of Marvin and broke our CCRs by granting an easement of our HOA Common Area for public use.

In addition, we have already proven the lack of expertise behind this project and its potential impacts on our community. The Village of Marvin broke ground on this project without *any of the required assessments and permits required for a floodway. We call upon the Village of Marvin Council Members to cancel this project and nullify the easement that the Marvin Creek HOA Board granted outside of their authority and without support of the Marvin Creek homeowners.

We urge all Marvin Creek residents to sign this petition so that together we can protect Marvin Creek from unnecessary disruption and potential harm.

*UPDATE:  We are opening this petition up to ALL MARVIN RESIDENTS in response to the VOM Council's decision to "table this" at Thursday's 2/29/24 VOM Council Work Session. They publicly acknowledged that they could use GO Bond funds for this project and characterized the opposition they've received as from "a couple of homeowners" - we've received over 100 signatures from Marvin Creek alone in just a few days - all VOM Council Members were sent a petition update on Wednesday evening 2/28/24.  The Council references the "greater good" and "future residents" as rationale for continuing action in the face of opposition by the most impacted residents.  I wish I had known and understood the plight of some of our fellow residents in other neighborhoods - I've learned a lot in these last two months watching past public meetings and plan to engage with those neighborhoods as well to see how we can collaborate and preserve the values of today's Marvin residents.  I don't believe that our community at large (whom the Council refers to as "the greater good") wants individual homeowners being significantly and negatively impacted by unnecessary and costly projects.  I think our Council should be listening to the residents that live in Marvin today, not holding out for "future residents".  Let's send a clear message that Marvin residents stick together - we do not want valuable taxpayer or grant funding used to support the Preserve-Marvin Creek Connector Trail.  GIVE BACK THE EASEMENT TO MARVIN CREEK THAT WAS GAINED IN BAD FAITH AND WITHOUT NOTIFICATION TO MARVIN CREEK RESIDENTS FROM THEIR HOA BOARD.
