The Issue
As independent carriers and small fleet operators, we face growing violations of our rights and privacy by freight brokers. One of the most invasive practices is the forced integration of Electronic Logging Devices (ELDs) through platforms like Highway as part of broker setup requirements. This practice exposes sensitive fleet data and strips carriers of our autonomy — all without proper regulation or oversight.
We are calling on the Federal Motor Carrier Safety Administration (FMCSA) to take immediate action and prohibit the forced integration of ELDs by freight brokers.
These integrations are often buried in setup packets, giving brokers unrestricted access to our live GPS, driver behavior, hours of service, and internal operations. This is not just unnecessary — it’s a violation of privacy and creates an uneven, exploitative power dynamic that puts small carriers at a massive disadvantage.
Furthermore, brokers use ELD access as a gatekeeping tool, blacklisting or refusing carriers who decline to integrate — effectively penalizing us for protecting our own data.
This is not about safety or transparency — it’s about control.
If tracking is required, there are secure, mutually agreed-upon alternatives available, such as MacroPoint, Project44, Trucker Tools, and standard check calls. There is no legitimate reason a broker should require back-end access to a carrier’s ELD.
According to the Owner-Operator Independent Drivers Association (OOIDA), brokers already operate in a largely opaque environment, often withholding true rate information from carriers. Now, with access to ELDs, they gain even more leverage — while we’re left with no privacy, no power, and shrinking profit margins.
This ends now.
We demand the following from FMCSA:
1. Ban the use of forced ELD integration in broker-carrier onboarding processes.
2. Prohibit brokers from blacklisting or rejecting carriers who decline ELD access.
3. Mandate the use of third-party, permission-based tracking alternatives if tracking is required.
This issue affects thousands of hardworking carriers across the U.S. and Canada. Our businesses, our data, and our livelihoods deserve protection.
